Dear Mr. Spirk:
I am the examining attorney assigned to review Polar Pro Filters Inc.’s trademark application for the mark GOLDEN HOUR. I have searched the Office records and have found no registered or pending marks that would bar registration of the proposed mark. However, the applicant must address the following issue before the mark will be approved for publication.
The wording “content (media)” is indefinite as a subject matter or field for the podcasts, MP3 files, MP3 recordings, om-line discussion board posts, webcasts, webinars and podcasts, news, and audio books” because it is too vague. The applicant must clarify the subject matter or delete the wording “content (media)” from the identification as suggested below. Further, the word “Photography” was misspelled and requires correction. The applicant may adopt the following amendment if accurate:
INTERNATINAL CLASS 9
Downloadable podcasts in the field of photography, videography, drone operation and travel; Downloadable MP3 files, MP3 recordings, on-line discussion board posts, webcasts, webinars and podcasts, news, and audio books in the field of photography, videography, drone operation and travel
If the proposed amendment is acceptable to your client, please reply to this email by authorizing the amendment or suggesting alternative language. If acceptable, I will enter the identification changes by examiner’s amendment. If you have questions or wish to discuss the matter, please contact me via email or telephone at the number listed below so I may assist you. I look forward to your reply.
Thank you
