I am the Trademark Examining Attorney at the United States Patent and Trademark Office reviewing your trademark application for CATER GATOR DASH (Serial No. 88324081), and I wanted to discuss the following issues with you.
Mark Description: The mark description should be amended because it does not adequately describe all features of the mark; specifically, the shaded shape pictured appears to an irregular quadrilateral rather than a rectangle. If it is agreeable, I propose amending to the following:
The mark consists of the term "CATER" next to the term "GATOR" inside of a shaded rectangular shape having a diagonally sloping right side over three stacked uneven lines next to the term "DASH".
Disclaimer Statement: Because it describes a purpose of applicant’s goods (i.e., that they can be used for catering), the wording “CATER” should be disclaimed. Thus, I propose adding the following disclaimer statement to the record:
No claim is made to the exclusive right to use “CATER” apart from the mark as shown.
