SECTION 2(e)(1) REFUSAL - MERELY DESCRIPTIVE
A mark is merely descriptive if “it immediately conveys information concerning a feature, quality, or characteristic of [an applicant’s] goods or services.” In re N.C. Lottery, 866 F.3d 1363, 1367, 123 USPQ2d 1707, 1709 (Fed. Cir. 2017) (citing In re Bayer Aktiengesellschaft, 488 F.3d 960, 963, 82 USPQ2d 1828, 1831 (Fed. Cir. 2007)); TMEP §1209.01(b); see DuoProSS Meditech Corp. v. Inviro Med. Devices, Ltd., 695 F.3d 1247, 1251, 103 USPQ2d 1753, 1755 (Fed. Cir. 2012) (quoting In re Abcor Dev. Corp., 588 F.2d 811, 814, 200 USPQ 215, 218 (C.C.P.A. 1978)).
The applied-for mark is GLITTER BEACH for “Coverups; Swimwear.”
The term GLITTER means small glittering objects used for ornamentation. See http://www.merriam-webster.com/dictionary/glitter. The term BEACH means a seashore area. See http://www.merriam-webster.com/dictionary/beach. The term BEACH is also used to refer to specific clothing worn at a seashore area. See http://www.merriam-webster.com/dictionary/beachwear (defining BEACHWEAR as clothing for wear at a beach). Thus, in the context of applicant’s goods, the applied-for mark immediately conveys that applicant’s goods are beachwear consisting of coverups and swimwear that contain glitter as a feature. Not only do the ordinary dictionary definitions show that the applied-for mark is descriptive, but evidence also exists that establishes the descriptive nature of the mark. Accordingly, for the foregoing reasons, the wording GLITTER BEACH merely describes a characteristic and feature of applicant’s goods.
Ultimately, when consumers encounter applicant’s goods using the mark GLITTER BEACH, they will immediately understand the mark as an indication of a characteristic and feature of applicant’s goods and not an indication that applicant is the source of the goods. Thus, based on the foregoing, applicant’s mark GLITTER BEACH merely describes a characteristic and feature of applicant’s goods and registration is refused under Section 2(e)(1) of the Trademark Act.
Response to SECTION 2(e)(1) REFUSAL
Although the examining attorney has refused registration, the applicant may respond to the refusal to register by submitting evidence and arguments in support of registration. In the alternative, please see the advisory below.
SUPPLEMENTAL REGISTRATION ADVISORY
If applicant files an acceptable allegation of use and also amends to the Supplemental Register, the application effective filing date will be the date applicant met the minimum filing requirements under 37 C.F.R. §2.76(c) for an amendment to allege use. TMEP §§816.02, 1102.03; see 37 C.F.R. §2.75(b). In addition, the undersigned trademark examining attorney will conduct a new search of the USPTO records for conflicting marks based on the later application filing date. TMEP §§206.01, 1102.03.

TEAS PLUS OR TEAS REDUCED FEE (TEAS RF) APPLICANTS – TO MAINTAIN LOWER FEE, ADDITIONAL REQUIREMENTS MUST BE MET, INCLUDING SUBMITTING DOCUMENTS ONLINE: Applicants who filed their application online using the lower-fee TEAS Plus or TEAS RF application form must (1) file certain documents online using TEAS, including responses to Office actions (see TMEP §§819.02(b), 820.02(b) for a complete list of these documents); (2) maintain a valid e-mail correspondence address; and (3) agree to receive correspondence from the USPTO by e-mail throughout the prosecution of the application.
