In response to the substantive refusal(s), please note the following:

Registrant hereby responds to the U.S. Patent and Trademark Office letter dated May 16, 2019. In the Office Action, the Examining Attorney refused registration of the ALTIMETER mark on the ground that there is a likelihood of confusion with the mark in U.S. Registration No. 3622734 (the "cited registration"). Trademark Act Section 2(d), 15 U.S.C. Section 1052(d). Applicant submit that there is no likelihood of confusion between the marks because Applicant is the owner of the cited registration as evidenced by the assignment document recorded at the U.S. Patent and Trademark Office Assignment Recordation Branch at Reel/Frame 6728/0299.
