The referenced application has been reviewed by the assigned trademark examining attorney. Applicant must respond timely and completely to the issues below. 15 U.S.C. §1062(b); 37 C.F.R. §§2.62(a), 2.65(a); TMEP §§711, 718.03.
SEARCH OF OFFICE’S DATABASE OF MARKS
The trademark examining attorney has searched the Office’s database of registered and pending marks and has found no conflicting marks that would bar registration under Trademark Act Section 2(d). TMEP §704.02; see 15 U.S.C. §1052(d).
SUMMARY OF ISSUES:
I. SECTION 2(e)(1) REFUSAL – MERELY DESCRIPTIVE
The Mark
The applied-for mark is ITUB, in standard characters, for “bathtubs and bath installations” in International Class 11.
Merely Descriptive Analysis
The applied-for mark ITUB merely describes a general type and feature of applicant’s goods, namely that they are bathtubs that may be connected to the Internet. The attached evidence from the American Heritage dictionary shows that a “tub” is “a bathtub”, and that a “bathtub” is “a tub for bathing, especially one installed in a bathroom.” The same evidence, as well as the attached evidence from AcronymFinder.com and Wikipedia.org, shows further that the letter “i” is commonly used in commerce to identify goods that may be connected to the Internet. Consumers would therefore understand the mark ITUB to identify bathtubs that may be connected to the Internet. A mark comprising the prefix “i” coupled with a descriptive or generic term for Internet-related goods may, moreover, be considered merely descriptive. See RxD Media, LLC v. IP Application Dev. LLC, 125 USPQ2d 1801, 1810-14 (TTAB 2018) (holding IPAD merely descriptive of web-based software for mobile-access database management in which users can store and access their personal information); In re Zanova, Inc., 59 USPQ2d 1300, 1304 (TTAB 2000) (holding ITOOL merely descriptive of computer software for use in creating web pages, and custom designing websites for others); TMEP §1209.03(d).
Applicant’s goods identified in this case are “bathtubs” and “bath installations”, which presumably encompass all goods of those types, including bathtubs and bath installations that may connected to the Internet. The attached evidence from US.Kohler.com, Customer.Microsoft.com, and Trendir.com shows, further, that Internet connected and/or controlled bath products and fixtures are currently being marketed and sold. The applied-for mark ITUB therefore merely describes a general type and feature of applicant’s goods, i.e. that they are bathtubs that may be connected to the Internet.
The combination of I and TUB in the applied-for mark does not alter or diminish the descriptive meaning of those terms. If the individual components of a mark retain their descriptive meaning in relation to the goods, the combination generally results in a composite mark that is itself descriptive and not registrable. In re Fat Boys Water Sports LLC, 118 USPQ2d 1511, 1516 (TTAB 2016) (citing In re Tower Tech, Inc., 64 USPQ2d 1314, 1317-18 (TTAB (2002)); TMEP §1209.03(d); see, e.g., Apollo Med. Extrusion Techs., Inc. v. Med. Extrusion Techs., Inc., 123 USPQ2d 1844, 1851 (TTAB 2017) (holding MEDICAL EXTRUSION TECHNOLOGIES merely descriptive of medical extrusion goods produced by employing medical extrusion technologies); In re Cannon Safe, Inc., 116 USPQ2d 1348, 1351 (TTAB 2015) (holding SMART SERIES merely descriptive of metal gun safes); In re King Koil Licensing Co., 79 USPQ2d 1048, 1052 (TTAB 2006) (holding THE BREATHABLE MATTRESS merely descriptive of beds, mattresses, box springs, and pillows). It is only where the combination of descriptive terms creates a unitary mark with a unique, incongruous, or otherwise non-descriptive meaning in relation to the goods and/or services is the combined mark registrable. See In re Colonial Stores, Inc., 394 F.2d 549, 551, 157 USPQ 382, 384 (C.C.P.A. 1968); In re Positec Grp. Ltd., 108 USPQ2d 1161, 1162-63 (TTAB 2013).
The applied-for mark ITUB in this case contains no design, stylization, punctuation, or grammatical characteristics that might alter the descriptive meaning of its component terms. Consumers who encounter the applied-for mark used in connection with applicant’s goods would understand the mark as merely conveying information about those goods, namely that applicant’s “bathtubs” and “bath installations” are bathtubs that may be connected to the Internet.
Conclusion
The applied-for mark ITUB merely describes a feature and general type of applicant’s goods. Registration of the applied-for mark on the Principal Register is therefore refused under Section 2(e)(1) of the Trademark Act.
Advisory – Section 2(f)
An intent-to-use applicant who has used the same mark on related goods and/or services may assert a claim of acquired distinctiveness under Trademark Act Section 2(f) before filing an allegation of use, if applicant can establish that, as a result of applicant’s use of the same mark on other goods and/or services, the mark has become distinctive of the goods and/or services in the intent-to-use application, and that this previously created distinctiveness will transfer to the goods and/or services in the intent-to-use application when use in commerce begins. In re Dial-A-Mattress Operating Corp., 240 F.3d 1341, 1347, 57 USPQ2d 1807, 1812 (Fed. Cir. 2001); In re Binion, 93 USPQ2d 1531, 1538 (TTAB 2009); TMEP §1212.09(a).
The Trademark Trial and Appeal Board has set forth the following two requirements for showing that a mark in an intent-to-use application has acquired distinctiveness:
(1) Applicant must establish that the same mark has acquired distinctiveness as to the other goods and/or services, by submitting evidence such as ownership of an active prior registration for the same mark for sufficiently similar or related goods and/or services, a prima facie showing of acquired distinctiveness based on five years’ use of the same mark with related goods and/or services, or actual evidence of acquired distinctiveness for the same mark with respect to the other goods and/or services; and
(2) Applicant must show sufficient relatedness of the goods and/or services in the intent-to-use application and those for which the mark has acquired distinctiveness to warrant the conclusion that the previously created distinctiveness will transfer to the goods and/or services in the application upon use. The showing necessary to establish relatedness will be decided on a case-by-case basis and will depend upon the nature of the goods and/or services involved and the language used to identify them in the application.
TMEP §1212.09(a); see Kellogg Co. v. Gen. Mills Inc., 82 USPQ2d 1766, 1770-71 (TTAB 2007); In re Rogers, 53 USPQ2d 1741, 1744-45 (TTAB 1999).

II. INFORMATION REQUIRED – SIGNIFICANCE OF THE MARK
(1) Explain whether any of the wording in the mark “ITUB” has any meaning or significance in the trade or industry in which applicant’s goods are manufactured or provided, any meaning or significance as applied to applicant’s goods, or if such wording is a term of art within applicant’s industry.
(2) Respond to the following questions:
-Are any of applicant’s goods electronic?
-Are any of applicant’s goods, or any features or components thereof, monitored, managed, regulated, customized, or controlled electronically?
-Are any of applicant’s goods capable of connecting to the Internet?
-Are any of applicant’s goods, or any features or components thereof, monitored, managed, regulated, customized, or controlled via an electronic network, e.g. the Internet?
-Will any of applicant’s goods be electronic?
-Will any of applicant’s goods, or any features or components thereof, be monitored, managed, regulated, customized, or controlled electronically?
-Will any of applicant’s goods be capable of connecting to the Internet?
-Will any of applicant’s goods, or any features or components thereof, be monitored, managed, regulated, customized, or controlled via an electronic network, e.g. the Internet?
