Application has been amended as shown below. As agreed to by Joseph Andras, attorney of record, on November 18, 2019, the examining attorney has amended the application as shown below. Please notify the examining attorney immediately of any objections. TMEP §707. Otherwise, no response is required. Id. In addition, applicant is advised that amendments to the goods and/or services are permitted only if they clarify or limit them; amendments that add to or broaden the scope of the goods and/or services are not permitted. 37 C.F.R. §2.71(a).
CLASS 16 – educational items, namely, educational activity sheets and pencil top erasers which are contained in a
blind bag which features an educational activity sheet and a related pencil top eraser as a surprise item, sold as a unit, and the blind bags marketed to
educators for motivational use by educators in the classroom
See TMEP §§1402.01, 1402.01(e).
OUTSTANDING REFUSALS AND REQUIREMNETS SATISFIED OR WITHDRAWN
In the May 3, 2019 Office action, the examining attorney refused registration based on a likelihood of confusion with a registered mark under Section 2(d) of the Trademark Act. Additionally, the applicant was required to provide additional information about its goods.
Based on the applicant’s response, it is noted that the applicant has provided the required additional information about its goods. Further, based on the amendments made to the identification of goods, the examining attorney has withdrawn the previously issued Section 2(d) refusal as to U.S. Registration No. 3800387.
As a result, all outstanding issues have been resolved.
GENERAL INFORMATION
If applicant has questions regarding this Examiner’s Amendment, please telephone or e-mail the assigned trademark examining attorney. All relevant e-mail communications will be placed in the official application record.
