SEARCH OF OFFICE’S DATABASE OF MARKS

 

The trademark examining attorney has searched the Office’s database of registered and pending marks and has found no conflicting marks that would bar registration under Trademark Act Section 2(d). TMEP §704.02; see 15 U.S.C. §1052(d).

 

In accordance with the authorization granted by Patrick Jennings on May 7, 2019, the trademark examining attorney has amended the application as indicated below. Please advise the undersigned immediately of any objections. Otherwise, no response is necessary. TMEP §707. 

 

IDENTIFICATIONS OF GOODS AMENDED

 

The identifications of goods is amended to read as follows: 

 

Class 9: Wearable activity trackers; Downloadable computer application software for mobile phones, namely, software for tracking and analyzing a user's posture in real time, sending notifications when the user has bad posture or is performing dangerous activities, and providing personalized coaching that shows users how to perform exercises to improve their posture; Electronic sensors for measuring and tracking a user's posture, not for medical use

 

Class 10: Compression garments; Back supports for medical purposes; Compression vests; Electronic sensors for measuring and tracking a user's posture for medical purposes

At this time, barring some unforeseen circumstance that might require further action, the application appears ready for publication in the Trademark Official Gazette.
