TO AVOID ABANDONMENT OF APPLICANT’S TRADEMARK APPLICATION, THE USPTO MUST RECEIVE APPLICANT’S COMPLETE RESPONSE TO THIS LETTER WITHIN 6 MONTHS OF THE ISSUE/MAILING DATE BELOW. A RESPONSE TRANSMITTED THROUGH THE TRADEMARK ELECTRONIC APPLICATION SYSTEM (TEAS) MUST BE RECEIVED BEFORE MIDNIGHT EASTERN TIME OF THE LAST DAY OF THE RESPONSE PERIOD.

The referenced application has been reviewed by the assigned trademark examining attorney. Applicant must respond timely and completely to the issue(s) below. 15 U.S.C. §1062(b); 37 C.F.R. §§2.62(a), 2.65(a); TMEP §§711, 718.03.
SEARCH OF OFFICE’S DATABASE OF MARKS
The trademark examining attorney has searched the Office’s database of registered and pending marks and has found no conflicting marks that would bar registration under Trademark Act Section 2(d). TMEP §704.02; see 15 U.S.C. §1052(d).
Mark on Drawing and Specimen Do Not Match
Registration is refused because the specimen does not show the mark in the drawing in use in commerce in International Class 30, which is required in the application. Trademark Act Sections 1 and 45, 15 U.S.C. §§1051, 1127; 37 C.F.R. §§2.34(a)(1)(iv), 2.56(a); TMEP §§904, 904.07(a), 1301.04(g)(i). The mark appearing on the specimen and in the drawing must match; that is, the mark in the drawing “must be a substantially exact representation of the mark” on the specimen. See 37 C.F.R. §2.51(a)-(b); TMEP §807.12(a).
In this case, the specimen displays the mark as the wording “MAHATMA” in red above “AMERICA’S FAVORITE RICE” in blue with a red and blue horizontal band with transparent space between on either side of “America’s Favorite Rice”. However, the drawing displays the mark as a gray rectangle with the wording “MAHATMA” in red above “AMERICA’S FAVORITE RICE” in blue with a red and blue horizontal band with transparent space between on either side of “America’s Favorite Rice,” on a white background that extends just beyond the edges of the wording and design on all sides. The mark on the specimen does not match the mark in the drawing because the mark on the specimen does not contain the white background or gray rectangle. Applicant has thus failed to provide the required evidence of use of the mark in commerce. See TMEP §807.12(a).
Applicant may respond to this refusal by satisfying one of the following:
(1) Submit a new drawing of the mark that shows the mark on the specimen and an amendment of the description and color claim that agrees with the new drawing. See 37 C.F.R. §2.72(a)-(b). The following amended description is suggested, if accurate: “The mark consists of the wording “MAHATMA” in red above “AMERICA’S FAVORITE RICE” in blue with a red and blue horizontal band with transparent space between on either side of “America’s Favorite Rice.” The following amended color claim is suggested, if accurate: “The colors red and blue are claimed as a feature of the mark”. Applicant may amend the mark in the drawing to match the mark on the specimen but may not make any other changes or amendments that would materially alter the drawing of the mark. See 37 C.F.R. §2.72(a)-(b); TMEP §807.14.
(2) Submit a different specimen (a verified “substitute” specimen) for each applicable international class that (a) shows the mark in the drawing in actual use in commerce for the goods in the application and (b) was in actual use in commerce at least as early as the filing date of the application.
Examples of specimens for goods include tags, labels, instruction manuals, containers, photographs that show the mark on the actual goods or packaging, and displays associated with the actual goods at their point of sale. See TMEP §§904.03 et seq. Webpages may also be specimens for goods when they include a picture or textual description of the goods associated with the mark and the means to order the goods. TMEP §904.03(i).

Applicant must respond to the additional requirements set forth below.
Disclaimer is RequiRed
In this case, applicant must disclaim the wording “AMERICAN’S FAVORITE” in the mark because it is not inherently distinctive. These unregistrable terms at best are merely laudatory and descriptive of the alleged merit of applicant’s goods. See 15 U.S.C. §§1052(e)(1); DuoProSS Meditech Corp. v. Inviro Med. Devices, Ltd., 695 F.3d 1247, 1256, 103 USPQ2d 1753, 1759 (Fed. Cir. 2012); TMEP §1209.03(k).
As indicated by attached dictionary evidence from The American Heritage Dictionary, the term “America” is a geographic term, which refers to the United States, and thus is primarily geographically descriptive of the origin of applicant’s goods. See 15 U.S.C. §§1052(e)(2); In re Societe Generale des Eaux Minerales de Vittel S.A., 824 F.2d 957, 959, 3 USPQ2d 1450, 1451-52 (Fed. Cir. 1987); TMEP §§1210.01(a), 1210.06(a), 1213.03(a). The additional attached definition from The American Heritage Dictionary, shows that “Favorite” means “liked or preferred above all others,” and thus is laudatory of applicant’s goods. “Self-laudatory or puffing marks are regarded as a condensed form of describing the character or quality of the goods [or services].” DuoProSS Meditech Corp. v. Inviro Med. Devices, Ltd., 695 F.3d at 1256, 103 USPQ2d at 1759 (quoting In re The Boston Beer Co., 198 F.3d 1370, 1373, 53 USPQ2d 1056, 1058 (Fed. Cir. 1999)). Thus, wording such as “ultimate,” “best,” “greatest,” and the like are generally considered laudatory and descriptive of an alleged superior quality of the goods. See In re Nett Designs, Inc., 236 F.3d 1339, 1342, 57 USPQ2d 1564, 1566 (Fed. Cir. 2001); In re The Boston Beer Co., 198 F.3d at 1373-74, 53 USPQ2d at 1058-59; In re Wileswood, Inc., 201 USPQ 400 (TTAB 1978) (AMERICA’S BEST POPCORN! and AMERICA’S FAVORITE POPCORN! merely descriptive of unpopped popcorn); TMEP §1209.03(k).
Applicant must also disclaim the wording “RICE” because it is not inherently distinctive either. This wording appears in applicant’s identification of goods and thus is descriptive of a feature of the goods.
Applicant may respond to this issue by submitting a disclaimer in the following format:
No claim is made to the exclusive right to use “AMERICA’S FAVORITE RICE” apart from the mark as shown.

Description of the Mark Requires Amendment
Applicant must submit an amended description of the mark. 37 C.F.R. §2.37; see TMEP §§808.01, 808.02. Applications for marks not in standard characters must include an accurate and concise description of the entire mark that identifies all the literal and design elements. See 37 C.F.R. §2.37; TMEP §§808 et seq. If the mark includes color, the drawing must show the mark in color. In addition, the application must include: (1) a claim that the color(s) is/are a feature of the mark; and (2) a color location statement in the "Description of the Mark" field naming the color(s) and describing where the color(s) appear(s) on the mark. 37 C.F.R. §2.52(b)(1). In this case, the drawing of the mark is not in standard characters.
Here, to the extent applicant submits a new specimen that matches the drawing in response to the refusal set forth at the beginning of this Office action, the description of the mark requires amendment to clarify whether the gray rectangular background is claimed, and if so, amend the color claim to include gray. If applicant does not amend the drawing in response to the refusal above, the following amended description of the mark is suggested, if accurate:
Applicant should note that in the event applicant opts to submit a revised drawing in response to the refusal set forth at the beginning of this Office action, applicant should amend the description of the mark and color claim as suggested in that section of the Office action.
