I am the examining attorney handling this application. I have reviewed the response to the office action. Thank you.
The amended drawing is acceptable and disclaimer are acceptable. However, to avoid any issues at publication review, I suggest we made a further amendment to the description of the mark to add that “the white in the mark represents background and/or transparent areas and is not part of the mark”. My apologies for not suggesting this initially. As amended, the description would read as follows (deleted information is in strikethrough format; new information is in bold):
The mark consists of the wording "MAHATMA" in red above "AMERICA'S FAVORITE RICE" in blue with a red and blue horizontal band
with transparent space betweenon either side of "America's Favorite Rice". The white in the mark represents background and/or transparent areas and is not part of the mark.With the direct authorization of Ms. Woodard, or another officer of the applicant, I can make this change to the description via examiner’s amendment, placing the application in order for approval and final review for publication.
Please advise. Kindly have the officer authorizing the amendment provide their name and title in the email.
