USPTO database searched; no conflicting marks found. The trademark examining attorney searched the USPTO database of registered and pending marks and found no conflicting marks that would bar registration under Trademark Act Section 2(d). 15 U.S.C. §1052(d); TMEP §704.02.
Application has been amended as shown below. The trademark examining attorney is amending the application as follows. No prior approval or authorization from applicant or applicant’s attorney is required. TMEP §707.02. Please notify the examining attorney immediately of any objections. TMEP §707. Otherwise, no response is required. Id. In addition, applicant is advised that amendments to the goods and/or services are permitted only if they clarify or limit them; amendments that add to or broaden the scope of the goods and/or services are not permitted. 37 C.F.R. §2.71(a).
Identification of Goods and Services
In addition, “for use global position systems (GPS)” must be amended to insert “in” before “global” for grammatical purposes. Similarly, “the” must be inserted before “internet” in “recorded computer application software for use in conducting social networking services via internet.”
The wording “Downloadable computer e-commerce software for facilitating commercial transaction Computer operating systems” in Class 9 also must be clarified. In this regard, a semicolon (or comma) must appear before “computer operating systems” as different items must be separated by commas or semicolons in an identification. In addition, for grammatical purposes, “transaction” should be plural, i.e., “transactions.”
In Class 35, “providing office function” must be amended to the “providing office functions” for grammatical purposes.
In light of the foregoing, the Class 9 and Class 35 identifications are amended to read as follows (the Class 36 identification remains unchanged). See TMEP §§1402.01, 1402.01(e).
