Dear Commissioner:

 

            This paper is filed in response to the Office Action dated April 19, 2019.  Applicant respectfully requests a reconsideration and advancement of the application to publication.

 

REMARKS

            In the Office Action, the Trademark Office advised that the filing dates of pending U.S. application Serial Numbers 87/228246 (‘246 Application), 87/380898 (‘898 Application), and 88/288526 (‘526 Application) precede Applicant’s filing date and that, if one or more of the marks in the referenced applications proceed to registration, Applicant’s mark may be refused registration under Section 2(d) of the Trademark Office.  This issue is addressed below. 

 

The Potential Refusal Under Section 2(d) Should Be Withdrawn

 

                        Applicant states for the record that the owner of the ‘246 Application and the ‘526 Application, Panasonic Corporation of North America, and the owner of the ‘898 Application, Panasonic Avionics Corporation, are wholly-owned subsidiaries of Panasonic Corporation.  Applicant further states for the record that Panasonic Corporation asserts control over the activities and operations of Panasonic Corporation of North America and Panasonic Avionics Corporation, including the selection, adoption, and use of the trademarks.  A Declaration under 37 CFR § 2.20 of Shigeo Yamamoto, the Authorized Signing Officer at Intellectual Property Center of Panasonic Corporation, is enclosed herewith.    

                        Pursuant to TMEP 1201.07(b)(ii), Applicant submits that the ‘246 Application and the ‘526 Application in the name of Panasonic Corporation of North America and the ‘898 Application in the name of Panasonic Avionics Corporation do not preclude registration of Applicant's mark.  Applicant requests that the potential refusal on this basis be withdrawn.

 

CONCLUSION

            Applicant respectfully requests reconsideration and subsequent withdrawal of the refusal based on the prior filed applications referenced above.  Applicant further requests advancement of its application to publication.
