Search Results
The trademark examining attorney has searched the Office’s database of registered and pending marks and has found no conflicting marks that would bar registration under Trademark Act Section 2(d). TMEP §704.02; see 15 U.S.C. §1052(d).
SUMMARY OF ISSUES that applicant must address:
REFUSAL – SECTION 2(e)(1) – MARK IS MERELY DESCRIPTIVE
Applicant has applied to register the mark INDIE for use in connection with “Provision of a web site featuring information on fashion” in Class 45.
The attached dictionary evidence from www.ahdictionary.com defines “indie” “an artistic work produced by an independent company or group” and “of, relating to, or being an indie,” while the attached Internet evidence from www.reference.com describes “indie style” in clothing describing a particular genre of fashion that is “alternative and non-corporate in design. . . [i]ndie is short for ‘independent,’ and . . . [i]ndie style often incorporates locally-produced fashion and vintage clothing.” Further, the attached Internet evidence shows that “indie” is commonly used to describe a particular genre of fashion.
Therefore, the mark INDIE, as applied to the identified services, merely describes a characteristic of applicant’s services. Accordingly, the proposed mark is merely descriptive, and registration is refused on the Principal Register under Section 2(e)(1) of the Trademark Act.
Advisory – Supplemental Register
REQUIREMENT – REQUEST FOR INFORMATION
(1) Fact sheets, instruction manuals, brochures, advertisements and pertinent screenshots of applicant’s website as it relates to the services in the application, including any materials using the terms in the applied-for mark. Merely stating that information about the services is available on applicant’s website is insufficient to make the information of record.;
(2) If these materials are unavailable, applicant should submit similar documentation for services of the same type, explaining how its own product or services will differ. If the services feature new technology and information regarding competing services is not available, applicant must provide a detailed factual description of the services. For services, the factual information must make clear what the services are and how they are rendered, salient features, and prospective customers and channels of trade. Conclusory statements will not satisfy this requirement.; and
(3) Applicant must respond to the following questions: Does applicant’s website feature, contain, or otherwise concern in any way indie fashion, i.e., independent clothing producers, shops, or style concepts? Please explain the significance of INDIE in relation to the identified services.

TEAS PLUS OR TEAS REDUCED FEE (TEAS RF) APPLICANTS – TO MAINTAIN LOWER FEE, ADDITIONAL REQUIREMENTS MUST BE MET, INCLUDING SUBMITTING DOCUMENTS ONLINE: Applicants who filed their application online using the lower-fee TEAS Plus or TEAS RF application form must (1) file certain documents online using TEAS, including responses to Office actions (see TMEP §§819.02(b), 820.02(b) for a complete list of these documents); (2) maintain a valid e-mail correspondence address; and (3) agree to receive correspondence from the USPTO by e-mail throughout the prosecution of the application. See 37 C.F.R. §§2.22(b), 2.23(b); TMEP §§819, 820. TEAS Plus or TEAS RF applicants who do not meet these requirements must submit an additional processing fee of $125 per class of goods and/or services. 37 C.F.R. §§2.6(a)(1)(v), 2.22(c), 2.23(c); TMEP §§819.04, 820.04. However, in certain situations, TEAS Plus or TEAS RF applicants may respond to an Office action by authorizing an examiner’s amendment by telephone or e-mail without incurring this additional fee.
