STRICT DEADLINE TO RESPOND TO THIS LETTER

TO AVOID ABANDONMENT OF APPLICANT’S TRADEMARK APPLICATION, THE USPTO MUST RECEIVE APPLICANT’S COMPLETE RESPONSE TO THIS LETTER WITHIN 6 MONTHS OF THE ISSUE/MAILING DATE BELOW.  A RESPONSE TRANSMITTED THROUGH THE TRADEMARK ELECTRONIC APPLICATION SYSTEM (TEAS) MUST BE RECEIVED BEFORE MIDNIGHT EASTERN TIME OF THE LAST DAY OF THE RESPONSE PERIOD.

TEAS PLUS OR TEAS REDUCED FEE (TEAS RF) APPLICANTS – TO MAINTAIN LOWER FEE, ADDITIONAL REQUIREMENTS MUST BE MET, INCLUDING SUBMITTING DOCUMENTS ONLINE:  Applicants who filed their application online using the lower-fee TEAS Plus or TEAS RF application form must (1) file certain documents online using TEAS, including responses to Office actions (see TMEP §§819.02(b), 820.02(b) for a complete list of these documents); (2) maintain a valid e-mail correspondence address; and (3) agree to receive correspondence from the USPTO by e-mail throughout the prosecution of the application.  See 37 C.F.R. §§2.22(b), 2.23(b); TMEP §§819, 820.  TEAS Plus or TEAS RF applicants who do not meet these requirements must submit an additional processing fee of $125 per class of goods and/or services.  37 C.F.R. §§2.6(a)(1)(v), 2.22(c), 2.23(c); TMEP §§819.04, 820.04.  However, in certain situations, TEAS Plus or TEAS RF applicants may respond to an Office action by authorizing an examiner’s amendment by telephone or e-mail without incurring this additional fee.  

 

The referenced application has been reviewed by the assigned trademark examining attorney.  Applicant must respond timely and completely to the issue(s) below.  15 U.S.C. §1062(b); 37 C.F.R. §§2.62(a), 2.65(a); TMEP §§711, 718.03.

 

NO CONFLICTING MARKS

 

The trademark examining attorney has searched the Office’s database of registered and pending marks and has found no conflicting marks that would bar registration under Trademark Act Section 2(d).  TMEP §704.02; see 15 U.S.C. §1052(d).

 

RECITATION OF SERVICES

 

The identification of services is indefinite and must be clarified because the nature of the services is unclear.  See 37 C.F.R. §2.32(a)(6); TMEP §1402.01.  Specifically, in class 35 the wording “Promoting the services, namely professional networking of others by means of providing online portfolios via a website” is unclear and awkwardly written.  In class 42 the following wording is unclear and requires further clarification:  “Computer services, namely, hosting an interactive web site that allows software for use in an electronic platform matching users with opportunities, database search, real time personal profiles, storage and sharing, social job search, social recruitment; Computer services, namely, hosting an interactive web site that allows editing, organizing, bookmarking, note taking, transmission, storage and sharing of data and information in the fields of business and social networking, opportunity, employment, careers and recruiting; Computer services, namely, hosting an interactive web site that allows uploading electronic documents such as certificates, research reports, articles, white papers, research thesis, publications, license forms, transcripts on topics of professional interest, all in the fields of business and social networking, recruiting and employment, and personal and career development; Computer services, namely, hosting an interactive web site that allows computer software for searching, locating and transferring information across global computer communications networks; Computer services, namely, hosting an interactive web site that allows managing data and providing information in the fields of recruiting, analytics and learning management.”

 

Applicant must amend this wording to specify the common commercial or generic name of the services.  See TMEP §1402.01.  If the services have no common commercial or generic name, applicant must describe or explain the nature of the services using clear and succinct language.  See id.

 

Applicant may substitute the following wording, if accurate: 

 

Class 35:         Appointment reminder services; Appointment scheduling services; Business networking; Confirming scheduled appointments for others; Confirming scheduled appointments for others in the field of healthcare.; Connecting qualified service providers with consumers; Employment recruiting services; On-line business networking services; Professional staffing and recruiting services; Promoting professional networking services of others by means of providing online portfolios via a website; Providing an employer with candidates or potential employees to fill temporary, contract and permanent positions; Providing an interactive web site featuring resume writing information to facilitate preparation of resumes; Providing business information, also via internet, the cable network or other forms of data transfer; Providing career information; Resume preparation; Updating and maintaining business contact information via the Internet.

 

Class 42:         Computer services, namely, hosting an interactive web site that allows use in professional and personal networking, opportunity searching and placement; Computer services, namely, hosting an interactive web site that allows users to match to job opportunities, to search databases, to share real time personal profiles, to perform social job search, and to conduct social recruitment; Computer services, namely, hosting an interactive web site that allows users to edit, organize, bookmark, take notes, transmit, store and share data and information in the fields of business and social networking, employment opportunities, employment, careers and recruiting; Computer services, namely, hosting an interactive web site featuring technology that allows users to upload electronic documents such as certificates, research reports, articles, white papers, research thesis, publications, license forms, transcripts on topics of professional interest, all in the fields of business and social networking, recruiting and employment, and personal and career development; Computer services, namely, hosting an interactive web site featuring non-downloadable computer software for searching, locating and transferring information across global computer communications networks; Computer services, namely, hosting an interactive web site featuring technology for use in managing data and providing information in the fields of recruiting, analytics and learning management; Developing customized web pages featuring user-defined information in the field of professional networking and building profiles and dashboards; File sharing services, namely, providing a website featuring technology enabling users to upload and download electronic files; Providing a website featuring a search engine for talent acquisition and tracking; Providing a website featuring technology that enables users to upload and share pictures and videos; Providing a website that gives users the ability to create customized web pages featuring user-defined profiles; Providing an interactive website featuring technology that allows users to create and share personal identity data with and among multiple online users and organizations; Providing electronic verification of on-line orders of digital content and generating electronic permission codes which then allow users to access said digital content; Providing temporary use of on-line non-downloadable software for managing data and providing information in the fields human capital, recruiting, and analytics for commercial use; Software as a service (SAAS) services featuring software for artificial intelligence for analysis of user skills and interest areas to match with and provide users employment and freelancing opportunities; Software as a service (SAAS) services featuring software for allowing employees to refer acquaintances to employment opportunities within their organization

 

 

 

Applicant may amend the identification to clarify or limit the goods and/or services, but not to broaden or expand the goods and/or services beyond those in the original application or as acceptably amended.  See 37 C.F.R. §2.71(a); TMEP §1402.06.  Generally, any deleted goods and/or services may not later be reinserted.  See TMEP §1402.07(e).

DESCRIPTION OF THE MARK
