I have reviewed your application. There are a couple of issues that I hope we handle by Examiner’s Amendment. They are as follows:
First, I would like to amend the translation statement from:
The English translation of Paso in the mark is path. The wording Oaks has no meaning in a foreign language.
To:
The English translation of “PASO” in the mark is “PATH.”
I think the information about “OAKS” is superfluous and should be deleted.
Second, you have disclaimed exclusive rights to use “OAKS” apart from the mark as shown. I do not think this is necessary and would like to give you the opportunity to withdraw this disclaimer. Please let me know if you would like me to delete the disclaimer.
Third, does the specimen you sent in show an actual bottle of your wine or is that a mock-up? It is a little difficult to tell from the digital image.
Please respond to the this email by sending me a reply email, if possible, by the close of business tomorrow, Wed., 4/24/19. I would be happy to enter any changes by Examiner’s Amendment.
