USPTO database searched; no conflicting marks found.  The trademark examining attorney searched the USPTO database of registered and pending marks and found no conflicting marks that would bar registration under Trademark Act Section 2(d).  15 U.S.C. §1052(d); TMEP §704.02.

Application has been amended as shown below.  As agreed to by KELLI D. ORTEGA on June 18, 2020, the examining attorney has amended the application as shown below.  Please notify the examining attorney immediately of any objections.  TMEP §707.  Otherwise, no response is required.  Id.  In addition, applicant is advised that amendments to the goods and/or services are permitted only if they clarify or limit them; amendments that add to or broaden the scope of the goods and/or services are not permitted.  37 C.F.R. §2.71(a).

The identification of goods for class 9 is amended to read as follows:  “downloadable software for operating and managing databases in the field of cardiology in the nature of downloadable software; recorded software for operating and managing databases in the field of cardiology in the nature of recorded software; downloadable software for operating and managing data banks in the field of cardiology in the nature of downloadable software; recorded software for operating and managing data banks in the field of cardiology in the nature of recorded software; downloadable software for use in medical diagnosis, namely, for analyzing medical data to assist in providing clinical interpretations; recorded software for use in medical diagnosis, namely, for analyzing medical data to assist in providing clinical interpretations; application software for handheld computers, namely, downloadable software for use in medical diagnosis, namely, for analyzing medical data to assist in providing clinical interpretations; application software for handheld computers, namely, recorded software for use in medical diagnosis, namely, for analyzing medical data to assist in providing clinical interpretations; downloadable computer software for use in medical diagnosis, namely, for analyzing medical data to assist in providing clinical interpretations; recorded computer software for use in medical diagnosis, namely, for analyzing medical data to assist in providing clinical interpretations; downloadable software applications for use in medical diagnosis, namely, for analyzing medical data to assist in providing clinical interpretations; recorded software applications for use in medical diagnosis, namely, for analyzing medical data to assist in providing clinical interpretations; software relating to data analytics being downloadable software for analyzing patient data from medical patient monitoring and diagnostic equipment; software relating to data analytics being recorded software for analyzing patient data from medical patient monitoring and diagnostic equipment; downloadable artificial intelligence software for use in medical diagnosis, namely, for analyzing medical data to assist in providing clinical interpretations; recorded artificial intelligence software for use in medical diagnosis, namely, for analyzing medical data to assist in providing clinical interpretations; downloadable software for use in medical diagnosis, namely, for interpreting the results of echocardiograms; recorded software for use in medical diagnosis, namely, for interpreting the results of echocardiograms; echocardiography software being downloadable software for interpreting the results of echocardiograms; echocardiography software being recorded software for interpreting the results of echocardiograms; all of the aforesaid goods relating to or connected with the identification, imaging, diagnosis and treatment of cardiovascular conditions and coronary heart disease.”  See TMEP §§1402.01, 1402.01(e).
