Hello, Mr. Zerounian,
I’m sorry - I just realized one more change is needed. For applications filed after Jan. 1, 2019, for Class 9 software, the office requires that the identification of goods specify either “downloadable” or “recorded”. The specimens here show the applicant’s goods to be a “downloadable” app.
In order to place this application in condition for approval, can you please reply, authorizing me to amend the identification of goods to the following:
Identification of Goods is amended to:
IC 009: Downloadable computer application software for mobile devices, namely, software for sending photos, videos, avatars, animations, images, text, and other digital data to others via a global computer network and mobile devices

(The wording LABS must be disclaimed because it describes the source of the goods, which are software labs. The Office requires that descriptive wording in a mark be disclaimed and LABS is always required to be disclaimed in relation to Class 9 software as describing the source of the goods.)
