SEARCH OF OFFICE’S DATABASE OF MARKS
The trademark examining attorney has searched the Office’s database of registered and pending marks and has found no conflicting marks that would bar registration under Trademark Act Section 2(d). TMEP §704.02; see 15 U.S.C. §1052(d).
DISCLAIMER REQUIRED
In this case, applicant must disclaim the wording “BOY” because it is not inherently distinctive. These unregistrable term(s) at best are merely descriptive of an ingredient, quality, characteristic, function, feature, purpose, or use of applicant’s goods and/or services. See 15 U.S.C. §1052(e)(1); DuoProSS Meditech Corp. v. Inviro Med. Devices, Ltd., 695 F.3d 1247, 1251, 103 USPQ2d 1753, 1755 (Fed. Cir. 2012); TMEP §§1213, 1213.03(a).
The attached evidence from Merriam-Webster.com shows this wording means “a male child from birth to adulthood”. Thus, the wording merely describes applicant’s goods in that it describes a characteristic and/or intended consumers of applicant’s applied-for goods, i.e., that they are intended to be used by male consumers.
Applicant may respond to this issue by submitting a disclaimer in the following format:

AMENDED MARK DESCRIPTION AND COLOR CLAIM
Applicant must submit an amended description of the mark because the current one is incomplete and does not describe all the significant aspects of the mark. 37 C.F.R. §2.37; see TMEP §§808.01, 808.02. Specifically, applicant’s description does not describe the white bands at the top and bottom of the mark. Descriptions must be accurate and identify all the literal and design elements in the mark. See 37 C.F.R. §2.37; TMEP §§808 et seq. As such, applicant must either describe the white bands at the top and bottom of the mark, or, if the white portion of the mark is intended to indicate background, outlining, shading, and/or transparent areas, applicant must specify that as well. TMEP §807.07(d); see 37 C.F.R. §2.61(b).
If the white bands are intended to be a part of the mark, the following description and color claim are suggested, if accurate:
The mark consists of a black background with the words “BEACH BOY” in blue stylized text, with white bands above and below the black background.
The color(s) black, white, and blue is/are claimed as a feature of the mark.
In the alternative, if the white bands are intended to represented background, outlining, shading, and/or transparent areas, the following description is suggested, if accurate:
The mark consists of a black background with the words “BEACH BOY” in blue stylized text. The color white represents background, outlining, shading, and/or transparent, and is not claimed as a feature of the mark.
RESPONSE OPTIONS
TEAS PLUS OR TEAS REDUCED FEE (TEAS RF) APPLICANTS – TO MAINTAIN LOWER FEE, ADDITIONAL REQUIREMENTS MUST BE MET, INCLUDING SUBMITTING DOCUMENTS ONLINE: Applicants who filed their application online using the lower-fee TEAS Plus or TEAS RF application form must (1) file certain documents online using TEAS, including responses to Office actions (see TMEP §§819.02(b), 820.02(b) for a complete list of these documents); (2) maintain a valid e-mail correspondence address; and (3) agree to receive correspondence from the USPTO by e-mail throughout the prosecution of the application.
