I am the Examining Attorney from the U.S. Patent and Trademark Office that has been assigned to review the application you filed for trademark protection, Application Serial No. 88287492, for the mark LA SKIES ABOVE THE REST.

 

I have completed my review of the application and have determined the following requirements must be addressed before the application can be moved forward.  These requirements are straight forward and can be corrected here at the Office using an Examiner’s Amendment.

 

Requirements:

1)      Disclaimer: 

 

I must require a disclaimer of the word “LA” as it geographically descriptive of the origin of the goods.  Specifically, LA is a city in southern California and is a known geographic location.  Additionally, your application indicates that you are located in the LA surrounding area.  Please note that a disclaimer does not alter the appearance of the mark in any way.  It is simply a statement that is made of record to acknowledge that you do not own the word “LA” by itself, and that others offering clothing in the LA area may use that wording to describe their goods.

 

2)     Identification: 

 

The identification of goods currently reads as follows:  “Clothing” in Class 025.  The word “clothing” is indefinite and not acceptable.  You must specifically identify the types of clothing that you will offer.  For example, you may state, “Clothing, namely, shirts, shorts, pants, dresses, and skirts” in Class 025, if accurate.  

 

May I amend the identification of goods as follows, if accurate:

 

International Class 025:

Clothing, namely, shirts, shorts, pants, dresses, and skirts.

 

Please feel free to review the US Acceptable Identification of Goods and Services Manual to see if there are other types of clothing you would like to include in the identification.  The manual is found here:  http://idm-tmng.gov.uspto.report/id-master-list-public.html

 

Please let me know if these amendments are acceptable.  If so I will issue an Examiner’s Amendment, make the changes to the application and move the application forward.  If the amendments are not acceptable or if you have further questions, please feel free to email me at the below email address, or call me at the phone number below. 

 

I must take action on your application by 5pm EST on Tuesday, April 23.  If I do not hear from you regarding the above mentioned requirements by that time, I will issue an Office Action with the information contained therein and you will have six (6) months to respond to the Office Action.
