SUGGESTED RESPONSE
In this case, applicant must disclaim the wording “SMART HOME” because it is not inherently distinctive. These unregistrable term(s) at best are merely descriptive of an ingredient, quality, characteristic, function, feature, purpose, or use of applicant’s goods. See 15 U.S.C. §1052(e)(1); DuoProSS Meditech Corp. v. Inviro Med. Devices, Ltd., 695 F.3d 1247, 1251, 103 USPQ2d 1753, 1755 (Fed. Cir. 2012); TMEP §§1213, 1213.03(a).
The attached evidence shows that SMART HOME refers to a residence or home equipped with lighting, heating, and electronic devices that can be controlled remotely by phone or computer. Applicant’s goods include, inter alia, “electric door bells; electric or electronic sensors for temperature, light, humidity, sound, vibration and motion; electronic control circuits for wireless fans; and home automation hubs using artificial intelligence comprised of voice-activated speakers, computer hardware, and software for controlling networked devices in the internet of things (IoT), operating internet-enabled and connected lighting apparatus and home security sensors and alarms”. Applicant’s goods are for use in a smart home. Thus, SMART HOME immediately and aptly describes a feature of the goods and must be disclaimed.
