This examiner’s amendment is supplemental to and supersedes the previous Office action issued on April 23, 2019 in connection with this application. Upon further review, additional clarification of the identification for Class 42 is required. Applicant has requested this requirement be resolved as outlined below.
In a previous Office action dated Apri1 23, 2019, the trademark examining attorney refused registration of the applied-for mark based on the following: refusal under Trademark Act Section 2(d) for a likelihood of confusion with the mark GENARIS in U.S. Registration No. 3829708. In addition, applicant was required to satisfy the following requirement: amend the identification of goods and services.
The Apri1 23, 2019 requirement to amend the identification is satisfied by applicant’s response. The refusal under Trademark Act Section 2(d) for a likelihood of confusion has also been obviated by cancellation of U.S. Registration No. 3829708. See TMEP §713.02.
Application has been amended as shown below. As agreed to by counsel Shawn B. Hussain on behalf of Charles Lew on May 19, 2020, the examining attorney has amended the application as shown below.
