DISCLAIMER REQUIRED

 

Applicant must provide a disclaimer of the unregistrable part(s) of the applied-for mark even though the mark as a whole appears to be registrable.  See 15 U.S.C. §1056(a); TMEP §§1213, 1213.03(a).  A disclaimer of an unregistrable part of a mark will not affect the mark’s appearance.  See Schwarzkopf v. John H. Breck, Inc., 340 F.2d 978, 979-80, 144 USPQ 433, 433 (C.C.P.A. 1965).

 

In this case, applicant must disclaim the wording “AMAZON SUPER BERRY AÇAÍ BOWL” because it is not inherently distinctive.  These unregistrable term(s) at best are merely descriptive of characteristics and features of applicant’s goods.  See 15 U.S.C. §1052(e)(1); DuoProSS Meditech Corp. v. Inviro Med. Devices, Ltd., 695 F.3d 1247, 1251, 103 USPQ2d 1753, 1755 (Fed. Cir. 2012); TMEP §§1213, 1213.03(a). 

 

Specifically, applicant’s goods feature açaí bowls, namely, fruit and fruit puree with toppings, featuring the açaí berry. See identification of goods and attached evidence from Chelsea’s Messy Apron and applicant’s Pinterest page showing the wording “açaí bowl” used descriptively for goods similar to applicant’s goods. Additionally, açaí is known as a superfood in the nature of a berry, a “super berry.” See evidence attached from Foodinsight.org and Mother Nature Network. Amazon describes a characteristic of the goods, the origin of the berries. See evidence attached from Wikipedia.

 

The wording “SUPERBERRY” must appear in its correct spelling, i.e., “SUPER BERRY” in the disclaimer. See In re Omaha Nat’l Corp., 819 F.2d 1117, 1119, 2 USPQ2d 1859, 1861 (Fed. Cir. 1987); In re Carlson, 91 USPQ2d 1198, 1203 (TTAB 2009); TMEP §1213.08(c).

 

If applicant does not provide the required disclaimer, the USPTO may refuse to register the entire mark.  See In re Stereotaxis Inc., 429 F.3d 1039, 1041, 77 USPQ2d 1087, 1089 (Fed. Cir. 2005); TMEP §1213.01(b).
