PRIOR-FILED APPLICATION MAY BAR REGISTRATION

The filing date of pending U.S. Application Serial No. 88040823 (QUALITYWORX CTS DATAHUB) precedes applicant’s filing date.  See attached referenced application.  If the mark in the referenced application registers, applicant’s mark may be refused registration under Trademark Act Section 2(d) because of a likelihood of confusion between the two marks.  See 15 U.S.C. §1052(d); 37 C.F.R. §2.83; TMEP §§1208 et seq.  Therefore, upon receipt of applicant’s response to this Office action, action on this application may be suspended pending final disposition of the earlier-filed referenced application.

In response to this Office action, applicant may present arguments in support of registration by addressing the issue of the potential conflict between applicant’s mark and the mark in the referenced application.  Applicant’s election not to submit arguments at this time in no way limits applicant’s right to address this issue later if a refusal under Section 2(d) issues.

Regardless of whether applicant opts to address the prior-filed application identified above, applicant must respond to the refusals and requirements set forth below.

SECTION 2(d) REFUSAL – LIKELIHOOD OF CONFUSION

The stated refusal refers to International Class 42 only and does not bar registration in the other class.

 

Registration of the applied-for mark is refused because of a likelihood of confusion with the mark in U.S. Registration No. 2582070 (QUALITYWORX).  Trademark Act Section 2(d), 15 U.S.C. §1052(d); see TMEP §§1207.01 et seq.  See the attached registration.

 

The applicant has applied to register the mark QUALITY WORKS for “Computer services, namely, providing temporary use of on-line, non-downloadable software to collect and transmit data from medical records for assessing and evaluating the clinical performance of hospitals and physicians”.  Registration is refused because of a likelihood of confusion with Registration No. 2582070 for QUALITYWORX for “computer software programs used to gather, store, analyze, archive and report data for use in manufacturing process operations.

 

Trademark Act Section 2(d) bars registration of an applied-for mark that is so similar to a registered mark that it is likely consumers would be confused, mistaken, or deceived as to the commercial source of the goods and/or services of the parties.  See 15 U.S.C. §1052(d).  Likelihood of confusion is determined on a case-by-case basis by applying the factors set forth in In re E. I. du Pont de Nemours & Co., 476 F.2d 1357, 1361, 177 USPQ 563, 567 (C.C.P.A. 1973) (called the “du Pont factors”).  In re i.am.symbolic, llc, 866 F.3d 1315, 1322, 123 USPQ2d 1744, 1747 (Fed. Cir. 2017).  Only those factors that are “relevant and of record” need be considered.  M2 Software, Inc. v. M2 Commc’ns, Inc., 450 F.3d 1378, 1382, 78 USPQ2d 1944, 1947 (Fed. Cir. 2006) (citing Shen Mfg. Co. v. Ritz Hotel Ltd., 393 F.3d 1238, 1241, 73 USPQ2d 1350, 1353 (Fed. Cir. 2004)); see In re Inn at St. John’s, LLC, 126 USPQ2d 1742, 1744 (TTAB 2018). 

 

Although not all du Pont factors may be relevant, there are generally two key considerations in any likelihood of confusion analysis:  (1) the similarities between the compared marks and (2) the relatedness of the compared goods and/or services.  See In re i.am.symbolic, llc, 866 F.3d at 1322, 123 USPQ2d at 1747 (quoting Herbko Int’l, Inc. v. Kappa Books, Inc., 308 F.3d 1156, 1164-65, 64 USPQ2d 1375, 1380 (Fed. Cir. 2002)); Federated Foods, Inc. v. Fort Howard Paper Co.,544 F.2d 1098, 1103, 192 USPQ 24, 29 (C.C.P.A. 1976) (“The fundamental inquiry mandated by [Section] 2(d) goes to the cumulative effect of differences in the essential characteristics of the goods [or services] and differences in the marks.”); TMEP §1207.01.

 

Additionally, where the marks of the respective parties are essentially identical, as in this case, the degree of similarity or relatedness between the goods and/or services needed to support a finding of likelihood of confusion declines.  See In re i.am.symbolic, llc, 116 USPQ2d 1406, 1411 (TTAB 2015) (citing In re Shell Oil Co., 992 F.2d 1204, 1207, 26 USPQ2d 1687, 1689 (Fed. Cir. 1993)), aff’d, 866 F.3d 1315, 123 USPQ2d 1744 (Fed. Cir. 2017); TMEP §1207.01(a).

 

Similarity of the Marks

 

Applicant’s proposed mark, QUALITYWORKS, is highly similar to Registration No. 2582070 for QUALITYWORX because the marks look highly similar, sound identical and convey the same meaning.  The only difference is registrant’s use of the alternative spelling of WORKS using an “X” rather than “KS” at the end of the registered mark.

 

Marks are compared in their entireties for similarities in appearance, sound, connotation, and commercial impression.  Stone Lion Capital Partners, LP v. Lion Capital LLP, 746 F.3d 1317, 1321, 110 USPQ2d 1157, 1160 (Fed. Cir. 2014) (quoting Palm Bay Imps., Inc. v. Veuve Clicquot Ponsardin Maison Fondee En 1772, 396 F.3d 1369, 1371, 73 USPQ2d 1689, 1691 (Fed. Cir. 2005)); TMEP §1207.01(b)-(b)(v).  “Similarity in any one of these elements may be sufficient to find the marks confusingly similar.”  In re Inn at St. John’s, LLC, 126 USPQ2d 1742, 1746 (TTAB 2018) (citing In re Davia, 110 USPQ2d 1810, 1812 (TTAB 2014)); TMEP §1207.01(b).

 

When comparing marks, “[t]he proper test is not a side-by-side comparison of the marks, but instead whether the marks are sufficiently similar in terms of their commercial impression such that [consumers] who encounter the marks would be likely to assume a connection between the parties.”  Cai v. Diamond Hong, Inc., __ F.3d __, 127 USPQ2d 1797, 1801 (Fed. Cir. 2018) (quoting Coach Servs., Inc. v. Triumph Learning LLC, 668 F.3d 1356, 1368, 101 USPQ2d 1713, 1721 (Fed. Cir. 2012)); TMEP §1207.01(b).  The proper focus is on the recollection of the average purchaser, who retains a general rather than specific impression of trademarks.  In re Inn at St. John’s, LLC, 126 USPQ2d 1742, 1746 (TTAB 2018) (citing In re St. Helena Hosp., 774 F.3d 747, 750-51, 113 USPQ2d 1082, 1085 (Fed. Cir. 2014); Geigy Chem. Corp. v. Atlas Chem. Indus., Inc., 438 F.2d 1005, 1007, 169 USPQ 39, 40 (CCPA 1971)); TMEP §1207.01(b).

 

Here, as stated, the applied-for mark QUALITYWORKS creates a highly similar commercial impression to the registered mark QUALITYWORX because the marks look nearly identical, differing by only the “KS” vs “X” at the end, and the marks sound identical and thus convey the same meaning.  Applicant’s use of the ordinary spelling of “works” does not obviate the overcall similarity.  The marks are essentially phonetic equivalents and thus sound similar.  Similarity in sound alone may be sufficient to support a finding that the marks are confusingly similar.  In re White Swan Ltd., 8 USPQ2d 1534, 1535 (TTAB 1988); see In re 1st USA Realty Prof’ls, Inc., 84 USPQ2d 1581, 1586 (TTAB 2007); TMEP §1207.01(b)(iv).  However here, as stated, the marks also look nearly identical and convey the same meaning.  Thus, it follows that the marks create a highly similar commercial impression.

 

Comparison of the Goods and Services

 

Applicant’s services are identified as “Providing temporary use of an online, non-downloadable performance measurement and patient safety data collection software system to help hospitals collect, report and analyze clinical quality core measure data”.  Registrant’s goods are identified as “computer software programs used to gather, store, analyze, archive and report data for use in manufacturing process operations.” 

 

The compared goods need not be identical or even competitive to find a likelihood of confusion.  See On-line Careline Inc. v. Am. Online Inc., 229 F.3d 1080, 1086, 56 USPQ2d 1471, 1475 (Fed. Cir. 2000); Recot, Inc. v. Becton, 214 F.3d 1322, 1329, 54 USPQ2d 1894, 1898 (Fed. Cir. 2000); TMEP §1207.01(a)(i).  They need only be “related in some manner and/or if the circumstances surrounding their marketing are such that they could give rise to the mistaken belief that [the goods and/or services] emanate from the same source.”  Coach Servs., Inc. v. Triumph Learning LLC, 668 F.3d 1356, 1369, 101 USPQ2d 1713, 1722 (Fed. Cir. 2012) (quoting 7-Eleven Inc. v. Wechsler, 83 USPQ2d 1715, 1724 (TTAB 2007)); TMEP §1207.01(a)(i).

 

The attached Internet evidence, consisting of the web pages identified below establish that the same entity commonly manufactures and provides software for collecting, storing and analyzing data for use in a variety of fields, including both manufacturing and healthcare. 

 

 

Thus, applicant’s services and registrant’s goods are considered related for likelihood of confusion purposes.  See, e.g., In re Davey Prods. Pty Ltd., 92 USPQ2d 1198, 1202-04 (TTAB 2009); In re Toshiba Med. Sys. Corp., 91 USPQ2d 1266, 1268-69, 1271-72 (TTAB 2009). 

 

Applicant’s Prior Registration

 

Although applicant has claimed ownership of prior registration No. 2674594, which has coexisted with the cited registration, the functionality of the software identified in the current application appears broader than that set forth in applicant’s prior registration because the data collection function is not limited data from medical records.  Further, based on the current record and identification of services, it is not clear whether applicant’s services involve the provision of only online downloadable software, or a “system” involving more than software, or whether the software or software system includes a performance measurement function more akin the analytics functionality in the prior registration, rather than performing only the function of collecting the data used to measure performance.  Accordingly, the coexistence of applicant’s prior registration with the cited registration is insufficient to obviate the refusal based on the current record and identification of services in Class 42. 

 

In sum, upon encountering QUALITYWORKS, used in connection with “Providing temporary use of an online, non-downloadable performance measurement and patient safety data collection software system to help hospitals collect, report and analyze clinical quality core measure data and QUALITYWORX, used in connection with “computer software programs used to gather, store, analyze, archive and report data for use in manufacturing process operations,” consumers are likely to be confused and mistakenly believe that the respective goods and services emanate from a common source. 

 

Although applicant’s mark has been refused registration, applicant may respond to the refusal by submitting evidence and arguments in support of registration.

 

If applicant responds to the refusal, applicant must respond to the additional refusal and requirements set forth below.

 

Specimen is Required

The stated refusal refers to International Class 35 only and does not bar registration in the other class.

Registration is refused because the specimen does not show the applied-for mark in use in commerce in connection with any of the services specified in International Class 35 in the application.  Trademark Act Sections 1 and 45, 15 U.S.C. §§1051, 1127; 37 C.F.R. §§2.34(a)(1)(iv), 2.56(a); In re Keep A Breast Found., 123 USPQ2d 1869, 1876-79 (TTAB 2017); In re Graystone Consulting Assocs., Inc., 115 USPQ2d 2035, 2037-38 (TTAB 2015); TMEP §§904, 904.07(a), 1301.04(d), (g)(i).  Specifically, the specimen is a screen capture from applicant’s website advertising applicant’s software tool.  The specimen describes the software tool, but does not otherwise refer to or show applicant’s provision of data management, collection and reporting services, other than as provided via the on-line non-downloadable software.

An application based on Trademark Act Section 1(a) must include a specimen showing the applied-for mark in use in commerce for each international class of services identified in the application.  15 U.S.C. §1051(a)(1); 37 C.F.R. §§2.34(a)(1)(iv), 2.56(a); TMEP §§904, 904.07(a). 

Examples of specimens for services include advertising and marketing materials, brochures, photographs of business signage and billboards, and webpages that show the mark used in the actual sale, rendering, or advertising of the services.  See TMEP §1301.04(a), (h)(iv)(C).  Specimens comprising advertising and promotional materials must show a direct association between the mark and the services.  TMEP §1301.04(f)(ii).

Applicant may respond to this refusal by satisfying one of the following for each applicable international class:

(1)       Submit a different specimen (a verified “substitute” specimen) that (a) was in actual use in commerce at least as early as the filing date of the application and (b) shows the mark in actual use in commerce for the services identified in the application.  A “verified substitute specimen” is a specimen that is accompanied by the following statement made in a signed affidavit or supported by a declaration under 37 C.F.R. §2.20:  “The substitute (or new, or originally submitted, if appropriate) specimen(s) was/were in use in commerce at least as early as the filing date of the application or prior to the filing of the amendment to allege use.”  The substitute specimen cannot be accepted without this statement.

(2)       Amend the filing basis to intent to use under Section 1(b), for which no specimen is required.  This option will later necessitate additional fee(s) and filing requirements such as providing a specimen.

Applicant must respond to the additional requirements set forth below.

IDENTIFICATION OF SERVICES REQUIRES AMENDMENT

The identification of services is indefinite and must be clarified for the reasons set forth below.  See 37 C.F.R. §2.32(a)(6); TMEP §1402.01. 

The USPTO has the discretion to determine the degree of particularity needed to clearly identify goods and/or services covered by a mark.  In re Fiat Grp. Mktg. & Corp. Commc’ns S.p.A, 109 USPQ2d 1593, 1597 (TTAB 2014) (citing In re Omega SA, 494 F.3d 1362, 1365, 83 USPQ2d 1541, 1543-44 (Fed. Cir. 2007)).  Accordingly, the USPTO requires the description of goods and/or services in a U.S. application to be specific, definite, clear, accurate, and concise.  TMEP §1402.01; see In re Fiat Grp. Mktg. & Corp. Commc’ns S.p.A, 109 USPQ2d at 1597-98; Cal. Spray-Chem. Corp. v. Osmose Wood Pres. Co. of Am., 102 USPQ 321, 322 (Comm’r Pats. 1954). 

The applicant insufficiently describes the following services in Class 35:

  • The wording “providing customized data management, collection and reporting services in the fields of hospital process improvement strategies, safe quality patient care, community health and population health management, medical management and hospital emergency preparedness” is indefinite because applicant must further clarify that the services are for business purposes.  Suggestions for amendment are set forth below.

The applicant insufficiently describes the following services in Class 42:

  • The wording “providing temporary use of an online, non-downloadable performance measurement and patient safety data collection software system to help hospitals collect, report and analyze clinical quality core measure data” is indefinite because applicant must clarify whether the software system is simply software, or if a system, applicant must indicate what the system is comprised of.  Applicant must also further clarify the functionality of the software by clarifying whether the software or software system performs an actual performance measurement function, or rather collects data that can be used for performance measure, or both.  Suggestions for amendment are set forth below. 

If accurate, the applicant may adopt (any or all of) the following identification of services. New information is in bold format.  Deleted information is in strikethrough format.  See TMEP §1402.01.

  • Class 35: Providing customized data management, Data collection, and reporting and customized data management services for business purposes in the fields of hospital process improvement strategies, safe quality patient care, community health and population health management, medical management and hospital emergency preparedness;
  • Class 42: Providing temporary use of an online, non-downloadable software for collecting clinical performance measurement and patient safety data collection software system to help for use by hospitals in collecting, reporting and analyzing clinical quality core measure data.

Applicant may amend the identification to clarify or limit the goods and/or services, but not to broaden or expand the goods and/or services beyond those in the original application or as acceptably amended.  See 37 C.F.R. §2.71(a); TMEP §1402.06.  Generally, any deleted goods and/or services may not later be reinserted.  See TMEP §1402.07(e).
