ARGUMENT(S)
The Examining Attorney has refused registration by raising the following issues: 1) Applicant's type of entity, 2) an alleged difference between the drawing and the specimen, 3) the identification of goods, and 4) an information requirement. Each of these is addressed in turn below.

1) Applicant has specified in the concurrently submitted amendments that Applicant is a British Columbia corporation, and as such submits that this requirement has been met.

2) Applicant has amended the goods previously proceeding under Sections 1(a) and 44(e) so as to proceed under Sections 1(b) and 44(e), and as such Applicant submits that this requirement has been met.

3) Applicant submits that the concurrently submitted amendments to the goods identification renders this refusal moot, and as such requests its withdrawal.

4) The Examining Attorney has required a response to four questions regarding VANAIR. Applicant, to the best of its knowledge, responds as follows:

1. VANAIR does not have any significance as applied to the goods other than its trademark significance.

2. VANAIR does not have any significance in the relevant trade or industry other than its trademark significance.

3. VANAIR does not have any geographic significance.

4. VANAIR does not have any meaning in a non-English language.

In response to the substantive refusal(s), please note the following:

The Examining Attorney has refused registration by raising the following issues: 1) Applicant's type of entity, 2) an alleged difference between the drawing and the specimen, 3) the identification of goods, and 4) an information requirement. Each of these is addressed in turn below.

1) Applicant has specified in the concurrently submitted amendments that Applicant is a British Columbia corporation, and as such submits that this requirement has been met.

2) Applicant has amended the goods previously proceeding under Sections 1(a) and 44(e) so as to proceed under Sections 1(b) and 44(e), and as such Applicant submits that this requirement has been met.
