EXAMINER’S AMENDMENT

 

 

Issue date:  August 27, 2019

 

 

USPTO database searched; no conflicting marks found.  The trademark examining attorney searched the USPTO database of registered and pending marks and found no conflicting marks that would bar registration under Trademark Act Section 2(d).  15 U.S.C. §1052(d); TMEP §704.02.

 

Application has been amended as shown below.  The trademark examining attorney is amending the application as follows.  No prior approval or authorization from applicant or applicant’s attorney is required.  TMEP §707.02.

 

IDENTIFICATION OF GOODS

 

The parentheses in the identification of goods has been removed and the parenthetical wording incorporated into the description of goods:  “Computer software applications, downloadable, namely, software applications for playing music, playing games, engaging in online shopping, accessing and viewing travel guides, communicating with others, processing and transmitting images, and taking, saving and storing photographs; Data processing apparatus, namely, Smart glasses; Data processing smart watches; Smart phones; Covers for smartphones; Cases for smartphones; Protective films adapted for smartphones; Wearable activity trackers; Selfie sticks; Connected bracelet in the nature of a measuring apparatus, namely, wearable activity trackers; Calorimeters; Flowmeters; Cabinets for loudspeakers; Headphones; Earphones; Materials for electricity mains, namely, electric wires and electric cables; Mobile power banks in the nature of rechargeable batteries.”  See TMEP §§1402.01, 1402.01(e).
