Applicant files this amendment in response to the Office Action dated August 2, 2019. In this regard, the Office approved the disclaimer and the
addition of and payment of fees for two classes of services, added by way of the prior-filed amendment. The only remaining issue requiring resolution is the requirement for a definite and acceptable
identifications of services for Classes 35, 37, and 42. Here, the services descriptions for Classes 37 and 42 have been amended in a manner wholly consistent with the descriptions proposed in the
Office Action. The services descriptions for Class 35 has been amended, in part, in a manner wholly consistent with the proposed description in the Office Action. The services descriptions for Class
35 also clarity around the phrase "commercial services for business-to-business transactions." While Applicant attempted to resolve this issue in its prior amendment, the Office asserts the
previously-amended services descriptions are outside the scope of either the original description, as filed, or as acceptably amended. In Class 35, Applicant used the term "commercial" in the
description "commercial services for business-to- business transactions" in relation to the definitions of "commercial" meaning (i) "concerned with or engaged in commerce," or (ii) "making or
intended to make a profit" and not the alternative definition of (iii) "a television or radio advertisement." The description "commercial services" offers support for certain services description in
Class 35, as amended. Applicant is now attempted to use common commercial terms relating to "commercial services" including business consulting, operations management, and business management, all of
which are encompassed in Class 35. More specifically, the specific services description provides: "Advertising, marketing and providing commercial consulting, management, and business operations
services for business-to-business transactions in the field of gasoline retail stores and convenience stores." Applicant believes that the services description is within the scope of the original
description of services, namely, "commercial services for business-to-business transactions, namely, engineering, maintenance, branding, merchandising/c-store services, technical services, IT
Services, and marketing services." If the Office disagrees, then such services description can be deleted from the application, which should proceed with the acceptable services descriptions in
