If applicant is an individual, applicant should simply request that the legal entity be amended to “individual” and must indicate his/her country of citizenship for the record. TMEP §803.03(a). Alternatively, if applicant is a limited liability company, applicant must provide the correct name of the limited liability company and the U.S. state or foreign country of incorporation or organization. TMEP §803.03(h).
If, in response to the above request, applicant provides information indicating that it is not the owner of the mark, registration may be refused because the application was void as filed. Applicant seeks registration of the wording “IT4CAST IT CAPACITY AND STRESS TEST” for “Assistance, advisory services and consultancy with regard to business planning, business analysis, business management, and business organization; Assistance, advisory services and consultancy with regard to business planning, business analysis, business management, business organization, marketing and customer analysis” in Class 035 and “Information technology consulting services; Planning, design and management of information technology systems” in Class 042.
The initialism “IT” represents “INFORMATION TECHNOLOGY”. See the attached definition. The words “CAPACITY” test and “STRESS TEST” are commonly used in the field of information technology to describe testing to determine how many users your application can handle before it becomes unstable and testing of software or hardware to determine whether its performance is satisfactory under any extreme and unfavorable conditions, which may occur as a result of heavy network traffic, process loading, etc.
Consumers would readily understand the wording to describe that applicant’s consulting services are related to IT capacity and stress tests.
