Unfortunately, the language of the first clause, “On-line retail store services in the field of nutrition, beauty and wellness”, would not be acceptable.  The removal of the original language “Promoting the goods and services of others by means of operating an online storefront with links to the retail websites of others” from my original suggestion would broaden the scope of your client’s applied-for services.

 

However, the second clause “Promoting the goods and services of others by means of operating an online storefront with links to the retail websites of others featuring goods and services of others in the field of nutrition, beauty, and wellness”.

 

Please let me know by tomorrow, 5:00PM EST, April 17th, 2019, if your client is ok with moving forward with the second clause only or with my original suggestion in my first e-mail: “Providing an online storefront with links to the goods and services of others, namely, on-line retail store services in the field of nutrition, beauty, and wellness; Promoting the goods and services of others by means of operating an online storefront with links to the retail websites of others featuring goods and services of others in the field of nutrition, beauty, and wellness”.

 

Alternatively, if your client insists upon the language you have suggested below, I can issue you an Office Action detailing the requirements above and stated in my previous e-mail.  Please feel free to give me a call or e-mail me back if you have any questions.

As the services include online retail which includes links to the goods and services of others, may we adopt the following:

 

                “On-line retail store services in the field of nutrition, beauty and wellness; Promoting the goods and services of others by means of operating an online storefront with links to the retail websites of others featuring goods and services of others in the field of nutrition, beauty, and wellness”

 

Given the original identification of services, I believe that “on-line retail store services in the field of nutrition, beauty and wellness” falls within the scope of “[p]roviding an online storefront with links to…,” inasmuch as “with” does not exclude other online retail activity in the field of nutrition, beauty, and wellness.

 

Please let me know if the foregoing is acceptable. If not, we will work to develop an alternative identification prior to close of business on Monday.

I am the assigned trademark examining attorney for Trademark Application Serial No. 88274771 ROOT.  There is just one minor amendment we need to make to the application before I can move the mark forward for publication.

 

Amendment of Identification of Services Required

 

The identification of services in the application is currently indefinite and needs to be amended to agree with the ID Manual.  I have included two suggestions for amended wording below for International Class 035 (changes are in bold):

 

Providing an online storefront with links to the goods and services of others, namely, on-line retail store services in the field of nutrition, beauty, and wellness

 

Promoting the goods and services of others by means of operating an online storefront with links to the retail websites of others featuring goods and services of others in the field of nutrition, beauty, and wellness
