TO AVOID ABANDONMENT OF APPLICANT’S TRADEMARK APPLICATION, THE USPTO MUST RECEIVE APPLICANT’S COMPLETE RESPONSE TO THIS LETTER WITHIN 6 MONTHS OF THE ISSUE/MAILING DATE BELOW. The referenced application has been reviewed by the assigned trademark examining attorney. Applicant must respond timely and completely to the issue(s) below. 15 U.S.C. §1062(b); 37 C.F.R. §§2.62(a), 2.65(a); TMEP §§711, 718.03.
SEARCH OF OFFICE’S DATABASE OF MARKS
The trademark examining attorney has searched the Office’s database of registered and pending marks and has found no conflicting marks that would bar registration under Trademark Act Section 2(d). TMEP §704.02; see 15 U.S.C. §1052(d).
SECTION 2(e)(1) REFUSAL - MERELY DESCRIPTIVE
Registration is refused because the applied-for mark merely describes a characteristic or purpose of applicant’s goods. Trademark Act Section 2(e)(1), 15 U.S.C. §1052(e)(1); see TMEP §§1209.01(b), 1209.03 et seq.
A mark is merely descriptive if “it immediately conveys knowledge of a quality, feature, function, or characteristic of [an applicant’s] goods or services.” In re The Chamber of Commerce of the U.S., 675 F.3d 1297, 1300, 102 USPQ2d 1217, 1219 (Fed. Cir. 2012) (quoting In re Bayer Aktiengesellschaft, 488 F.3d 960, 963, 82 USPQ2d 1828, 1831 (Fed. Cir. 2007)); TMEP §1209.01(b); see DuoProSS Meditech Corp. v. Inviro Med. Devices, Ltd., 695 F.3d 1247, 1251, 103 USPQ2d 1753, 1755 (Fed. Cir. 2012) (quoting In re Abcor Dev. Corp., 588 F.2d 811, 814, 200 USPQ 215, 218 (C.C.P.A. 1978)).
In the present case, applicant’s proposed mark is GRAB BAG for “Novelty toy items in the nature of amusement gag or practical joke; Novelty toy items in the nature of prank toys; Novelty toys for playing jokes; Plastic novelty toy items in the nature of Halloween-themed items, namely, ghosts, skeleton hands, zombie hands, mummy hands, and other scary items that pop out from a cloth bag.”
The attached dictionary evidence from The American Heritage Dictionary of the English Language shows that GRAB BAG means “A container filled with articles, such as party gifts, to be drawn unseen”. Additionally, the specimen showing an Amazon product page states “Adults – use the bag to give out candy and surprise the kids!”.
Based on this evidence, GRAB BAG merely describes a characteristic or purpose of applicant’s goods, i.e., applicant’s novelty toys are containers (cloth bags) to be filled with articles, such as party gifts and candy, to be drawn unseen by partygoers and/or trick-or-treaters.
Applicant’s proposed mark is therefore refused as merely descriptive under Trademark Act Section 2(e)(1).
Applicant should note the following additional ground for refusal.
REFUSAL – MARK DIFFERS ON DRAWING AND SPECIMEN
Registration is refused because the specimen does not show the mark in the drawing in use in commerce in International Class 28, which is required in the application or amendment to allege use. Trademark Act Sections 1 and 45, 15 U.S.C. §§1051, 1127; 37 C.F.R. §§2.34(a)(1)(iv), 2.56(a); TMEP §§904, 904.07(a), 1301.04(g)(i). The mark appearing on the specimen and in the drawing must match; that is, the mark in the drawing “must be a substantially exact representation of the mark” on the specimen. See 37 C.F.R. §2.51(a)-(b); TMEP §807.12(a).
In this case, the specimen displays the mark as HALLOWEEN GRAB BAG. However, the drawing displays the mark as GRAB BAG. The mark on the specimen does not match the mark in the drawing because it includes the extra term HALLOWEEN. Applicant has thus failed to provide the required evidence of use of the mark in commerce. See TMEP §807.12(a).
Applicant may respond to this refusal by satisfying one of the following:
(1) Submit a different specimen (a verified “substitute” specimen) for each applicable international class that (a) shows the mark in the drawing in actual use in commerce for the goods and/or services in the application or amendment to allege use, and (b) was in actual use in commerce at least as early as the filing date of the application or prior to the filing of an amendment to allege use.
Examples of specimens for goods include tags, labels, instruction manuals, containers, photographs that show the mark on the actual goods or packaging, and displays associated with the actual goods at their point of sale. See TMEP §§904.03 et seq. Webpages may also be specimens for goods when they include a picture or textual description of the goods associated with the mark and the means to order the goods. TMEP §904.03(i).
(2) Submit a request to amend the filing basis to intent to use under Section 1(b), for which no specimen is required. This option will later necessitate additional fee(s) and filing requirements such as providing a specimen.
The USPTO will not accept an amended drawing submitted in response to this refusal because the changes would materially alter the drawing of the mark in the original application or as previously acceptably amended. See 37 C.F.R. §2.72(a)-(b); TMEP §807.14. Specifically, adding the term “HALLOWEEN” changes the commercial impression by indicating to consumers the intended use of the goods, limited to a particular holiday.

If applicant responds to the refusals, applicant must also respond to the requirement set forth below.
REQUIREMENT – AMEND IDENTIFICATION OF GOODS
The wording “Novelty toy items in the nature of amusement gags or practical jokes; Novelty toy items in the nature of prank toys; Plastic novelty toy items in the nature of Halloween-themed items, namely, ghosts, skeleton hands, zombie hands, mummy hands, and other scary items that pop out from a cloth bag” is indefinite and must be clarified because the nature and purpose of the goods is not sufficiently specified. See 37 C.F.R. §2.32(a)(6); TMEP §1402.01.
Applicant may adopt the following identification of goods, if accurate:
Class 28: Novelty toy items for playing jokes in the nature of amusement gags or practical jokes; Novelty toy items for playing jokes in the nature of prank toys; Novelty toys for playing jokes; Plastic novelty toy items for playing jokes in the nature of Halloween-themed items, namely, ghosts, skeleton hands, zombie hands, mummy hands, and other scary items that pop out from a cloth bag

TEAS PLUS OR TEAS REDUCED FEE (TEAS RF) APPLICANTS – TO MAINTAIN LOWER FEE, ADDITIONAL REQUIREMENTS MUST BE MET, INCLUDING SUBMITTING DOCUMENTS ONLINE: Applicants who filed their application online using the lower-fee TEAS Plus or TEAS RF application form must (1) file certain documents online using TEAS, including responses to Office actions (see TMEP §§819.02(b), 820.02(b) for a complete list of these documents); (2) maintain a valid e-mail correspondence address; and (3) agree to receive correspondence from the USPTO by e-mail throughout the prosecution of the application. See 37 C.F.R. §§2.22(b), 2.23(b); TMEP §§819, 820.
