Dear Attorney,
I have been in Idaho and Montana all spring, summer and fall.
My trademark specimen does NOT contain any CBD.
Therefore, the FDA and the FDCA should not be cited against my application.
My specimen clearly shows simple HEMP SEED OIL @ $10.99 + S&H for 9.5 oz.
My original description identification is true: Dietary and nutritional supplements containing industrial hemp.
As per your office action, you suggested an amendment to my identification:
"Therefore, in order to overcome this refusal, applicant must amend the identification of goods and services to specify that all cannabis-containing items are “solely derived from hemp with a delta-9 tetrahydrocannabinol [THC] concentration of not more than 0.3 percent on a dry weight basis.”
* This application should move forward, be published and registered on the Principal Register.
