OFFICE ACTION
TO AVOID ABANDONMENT OF APPLICANT’S TRADEMARK APPLICATION, THE USPTO MUST RECEIVE APPLICANT’S COMPLETE RESPONSE TO THIS LETTER WITHIN 6 MONTHS OF THE ISSUE/MAILING DATE BELOW. A RESPONSE TRANSMITTED THROUGH THE TRADEMARK ELECTRONIC APPLICATION SYSTEM (TEAS) MUST BE RECEIVED BEFORE MIDNIGHT EASTERN TIME OF THE LAST DAY OF THE RESPONSE PERIOD.

The referenced application has been reviewed by the assigned trademark examining attorney. Applicant must respond timely and completely to the issue(s) below. 15 U.S.C. §1062(b); 37 C.F.R. §§2.62(a), 2.65(a); TMEP §§711, 718.03.
On January 25, 2019, applicant amended the application in order to amend the drawing of the mark. This amendment is unacceptable for the reasons specified below.
SUMMARY OF ISSUES:
DRAWING AMENDMENT UNACCEPTABLE
The original drawing shows the mark as BIOME. The proposed amended drawing shows the mark as BIOMIE.
The USPTO cannot accept an amendment to a mark if it will materially alter the mark in the drawing filed with the original application. 37 C.F.R. §2.72(a)(2), (b)(2); TMEP §807.14. An amendment to the mark is material when the USPTO would need to republish the mark with the change in the USPTO Trademark Official Gazette to fairly present the mark to the public. In re Thrifty, Inc., 274 F.3d 1349, 1352, 61 USPQ2d 1121, 1123-24 (Fed. Cir. 2001) (citing In re Hacot-Columbier, 105 F.3d 616, 620, 41 USPQ2d 1523, 1526 (Fed. Cir. 1997)); TMEP §807.14.
That is, an amendment is material if the altered mark does not retain “the essence of the original mark” or if the new and old forms do not “create the impression of being essentially the same mark.” In re Hacot-Columbier, 105 F.3d at 620, 41 USPQ2d at 1526 (quoting Visa Int’l Serv. Ass’n v. Life-Code Sys., Inc., 220 USPQ 740, 743-44 (TTAB 1983)); see, e.g., In re Who? Vision Sys., Inc., 57 USPQ2d 1211, 1218 (TTAB 2000) (amendment from “TACILESENSE” to “TACTILESENSE” a material alteration); In re CTB Inc., 52 USPQ2d 1471, 1475 (TTAB 1999) (amendment of TURBO with a design to just the typed word TURBO without design a material alteration).
When determining materiality, the addition of any element that would require a further search of the USPTO database for conflicting marks is also relevant. In re Guitar Straps Online LLC, 103 USPQ2d 1745, 1747 (TTAB 2012) (citing In re Pierce Foods Corp., 230 USPQ 307, 308-09 (TTAB 1986)); In re Who? Vision Sys. Inc., 57 USPQ2d at 1218-19; TMEP §807.14.
In the present case, applicant’s proposed amendment would materially alter the mark in the drawing filed with the original application because the original drawing has a different meaning and thus, different commercial impression than the proposed amended mark.
To avoid the application from abandoning, applicant must respond to this issue. TMEP §807.17. Applicant may respond by (1) withdrawing the request to amend the drawing, or (2) arguing that the proposed amendment is not a material alteration of the mark.

PRIOR FILED APPLICATION
In response to this Office action, applicant may present arguments in support of registration by addressing the issue of the potential conflict between applicant’s mark and the mark in the referenced application. Applicant’s election not to submit arguments at this time in no way limits applicant’s right to address this issue later if a refusal under Section 2(d) issues.
REFUSAL – SECTION 2(e)(1) – MARK IS MERELY DESCRIPTIVE
The applied-for mark is BIOME (in standard character form) for “Construction materials in the nature of non-metal composites and organic materials” in International Class 19 and “Construction services for structures utilizing composite materials, organic materials, and organic structural elements” in International Class 37.
The attached evidence from ahdictionary.com and Wikipedia.org shows that the wording BIOME means “[a] major regional or global biotic community, such as grassland or desert, characterized chiefly by its prevailing climate and vegetation.” Additional attached evidence from orb-studio.com (applicant’s website), biome-solutions.com, architecturalharmonics.com, architectmagazine.com, and timberprocessing.com shows that the wording is commonly used in connection with similar goods and/or services to mean integrating building construction with the surrounding ecological system and/or the type of building construction materials. Thus, the applied-for mark is merely descriptive of a characteristic and/or feature of applicant’s goods and services, namely, a type of building construction and/or building materials.
Based on the evidence and analysis above, applicant’s applied-for mark is merely descriptive and must be refused under Section 2(e)(1) of the Lanham Act.
In addition to being merely descriptive, the applied-for mark appears to be generic in connection with the identified goods and, therefore, incapable of functioning as a source-identifier for applicant’s goods. In re Gould Paper Corp., 834 F.2d 1017, 5 USPQ2d 1110 (Fed. Cir. 1987); In re Empire Tech. Dev. LLC, 123 USPQ2d 1544 (TTAB 2017); see TMEP §§1209.01(c) et seq., 1209.02(a). Under these circumstances, neither an amendment to proceed under Trademark Act Section 2(f) nor an amendment to the Supplemental Register can be recommended. See TMEP §1209.01(c).
REQUIREMENT – AMEND IDENTIFICATION OF GOODS AND SERVICES
The identification of services is indefinite and must be clarified because the wording does not indicate the nature of the services. See 37 C.F.R. §2.32(a)(6); TMEP §1402.01. Applicant may adopt the following identification, if accurate: Building construction services for structures utilizing composite materials, organic materials, and organic structural elements.

Class 19: Construction materials in the nature of non-metal composites and organic materials panels
Class 37: Building construction services for structures utilizing composite materials, organic materials, and organic structural elements
