EXAMINER’S AMENDMENT

 

 

Issue date:  October 23, 2019

 

In a previous Office Action dated March 29, 2019, the examining attorney refused registration under Section 2(d) for a likelihood of confusion with U.S. Registration No. 3896310 in International Class 9 only. The examining attorney also required that applicant amend the identification of goods and services. Applicant submitted a response on September 25, 2019. The refusal under Section 2(d) is hereby satisfied. Applicant also amended the identification of goods and services, however upon further review, further amendment was required.

 

Application has been amended as shown below.  As agreed to by Ms. Shannon M. Nolley, qualified practitioner at Gesmer Updegrove LLP, on October 23, 2019, the examining attorney has amended the application as shown below.  Please notify the examining attorney immediately of any objections.  TMEP §707.  Otherwise, no response is required.  Id.  In addition, applicant is advised that amendments to the goods and/or services are permitted only if they clarify or limit them; amendments that add to or broaden the scope of the goods and/or services are not permitted.  37 C.F.R. §2.71(a).

 

IDENTIFICATION OF GOODS AMENDED

 

The identification of goods and services in International Classes 20 and 28 are amended to read as follows:   

 

Class 20:  “Plastic key chain tags, key chain tags, and non-metal key holders; picture frames; holiday ornaments of plastic”

 

Class 28:   “Toys and playthings, namely, action figure toys, balloons, inflatable float mattresses and pads for recreational use, flying discs, inflatable toys, model trains, and water squirting toys; Christmas tree ornaments, excluding confectionary and electric Christmas tree lights”

 

The goods and services in the remaining classes remain unchanged.
