The trademark examining attorney has searched the Office’s database of registered and pending marks and has found no conflicting marks that would bar registration under Trademark Act Section 2(d). TMEP §704.02; see 15 U.S.C. §1052(d).
Section 2(e)(1) Refusal – Merely Descriptiveness
The applicant’s mark is “GLACIER BAY” for the goods “Oysters, live; Live oysters.” The attached evidence from Romancing the Foam, ProFish, Seacore, and Oysterater identifying “GLACIER BAY” as a type of oyster from New Brunswick. As a result, the proposed mark merely describes the applicant’s goods because consumers are likely to view “GLACIER BAY” as identifying a type of oyster. A Section 2(e)(1) refusal is issued in the present case.
