That is correct that no disclaimer is needed for this application.
One other question – is “1” part of the literal element of the mark or should that just be “QP”? I can update it in our system if there is no “1”. I don’t know how that got in there.

Good afternoon Mr. Lanquist,
Further to my voicemail, I wanted to reach out to you regarding the above-referenced application because the application has just a few minor issues that can be resolved via an Examiner’s Amendment and without the need for an Office Action. In particular, the colors referenced in the color claim (red and black) do not match those in the drawing (gray and red) and should therefore be clarified. Furthermore, it is unclear whether white is a feature of the mark or whether it is background. Additionally, the mark description does not describe all aspects of the mark, including the colors featured in the mark, and should therefore be amended to reference all significant aspects of the mark. Assuming that white is not a feature of the mark, I would suggest that the mark description and color claim be amended to read as follows:
Color Claim: The color(s) red and gray is/are claimed as a feature of the mark
Mark Description: The mark consists of a design of a grotesque man and the wording “QP1” in stylized font, wherein the man’s head is formed by the letter “Q” in gray, stylized font and the man’s body is formed by two red vertical lines. A red curved band extends from each of the vertical lines to form the man’s arms. The letter “P” is formed by the right vertical line and curved band. Below the design of the grotesque man is a gray crescent shape that curves upwards towards the man. The color white represents background, outlining, shading, and/or transparent area and is not part of the mark.
Also, could you please specify where “1” appears in the mark? I was not able to see it, but wanted to include it in the mark description.
If white is an aspect of the mark, the color claim and mark description should be amended to include white and reference the location of the color in the mark.
If you would like to proceed with an Examiner’s Amendment, please let me know how you would like to amend the mark description and color claim and please confirm that you approve of the disclaimer of “QUALITY PERSONNEL” no later than 5 PM ET on Thursday, March 28, 2019.
