EXAMINER’S AMENDMENT
ISSUE/MAILING DATE: 3/26/2019
DATABASE SEARCH: The trademark examining attorney has searched the USPTO’s database of registered and pending marks and has found no conflicting marks that would bar registration under Trademark Act Section 2(d). TMEP §704.02; see 15 U.S.C. §1052(d).
APPLICATION HAS BEEN AMENDED: In accordance with the authorization granted by Edward D. Lanquist, Jr. on March 26, 2019, the trademark examining attorney has amended the application as indicated below.
MARK DESCRIPTION AND COLOR CLAIM AMENDED
The colors red and gray are claimed as a feature of the mark.
The mark consists of a design of a grotesque man and the wording “QP” in stylized font, wherein the man’s head is formed by the letter “Q” in gray, stylized font and the man’s body is formed by two red vertical lines. A red curved band extends from each of the vertical lines to form the man’s arms. The letter “P” is formed by the right vertical line and curved band. Below the design of the grotesque man is a gray crescent shape that curves upwards towards the man. The color white represents background, outlining, shading, and/or transparent area and is not part of the mark.
37 C.F.R. §2.52(b)(1); TMEP §807.07(a)(i), (a)(ii).
Please advise the undersigned immediately of any objections. Otherwise, no response is necessary. TMEP §707. Any amendments to the identification of goods and/or services may clarify or limit the goods and/or services, but may not add to or broaden the scope of the goods and/or services. 37 C.F.R. §2.71(a); see TMEP §§1402.06 et seq.
