Dear Attorney Cleveland,

If I understand correctly, the applicant seeks to adopt the following amended identification of services in International Class 42:

“Software as a service (SAAS) services, namely, hosting software for use by others for use as an automated process for a comprehensive marketing program featuring branding, advertising, promotions, sales, digital marketing, traditional marketing, and pricing, including evaluation and tracking of marketing return on investment, in the field of marketing intelligence.”

Is this the amended identification of services  the applicant wishes to adopt?  If so, do you want me to enter this amendment via an Examiner’s Amendment?

Please advise.

Ms. Sapp,

I just spoke with my client. The thinking is to add items related to sales (to meet your requirements).

Would these terms be acceptable?

Digital Marketing

Traditional Marketing

Branding

Promotions

Sales

Advertising

Pricing

Dear Attorney Darryl Cleveland,

I am the examining attorney assigned to the above identified application.  The amended identification of services stated in the applicant’s incoming correspondence received on 04/15/2019 is unacceptable because it includes parentheses and the term “etc.”  Parentheses and brackets are reserved for post registration purposes and must be removed from the identification.  The term “etc.” suggests that there may be other services which have not been identified.  The applicant may adopt the following amended identification of services if acceptable:

International Class 42:  Software as a service (SAAS) services, namely, hosting software for use by others for use as an automated process for a comprehensive marketing program featuring branding, advertising, and sales, including evaluation and tracking of marketing return on investment, in the field of marketing intelligence.

Please advise if this amendment is acceptable, and if so, I can enter it on behalf of the applicant via an Examiner’s Amendment.

I look forward to your response.

Thank you.

Sincerely,
