Application serial no. 88259078 WONDERFUL(Standard Characters, see http://uspto.report/TM/88259078/mark.png) has been amended as follows:

ARGUMENT(S)
In response to the substantive refusal(s), please note the following:

Applicant respectfully requests that the Examining Attorney withdraw the Section 2(d)  - Likelihood of Confusion - Class 5 Only Refusal, as the applied-for mark has now been assigned to The Wonderful Company LLC, owner of the cited registration POM WONDERFUL (Registration No. 3687492). Attached hereto as Exhibit A is a copy of the Assignment Confirmation Receipt.

For the reasons discussed above, there is no likelihood of confusion between the applied-for mark and the cited registration and, as such, Applicant respectfully requests that the Examining Attorney withdraw the refusal and pass the mark to publication.
