Good Afternoon Mallory Levitt,
I am reviewing the additional applications referenced above for your client, Simon & Schuster, Inc. In review of these applications there are a couple of issues that can be corrected without the need for an office action.
1. DISCLAIMER
We require a disclaimer of the word “PRESS” in each of the SP SIGNAL PRESS and SIGNAL PRESS marks because it is descriptive of applicant’s goods and services. The suggested disclaimer would read:
“No claim is made to the exclusive right to use “PRESS” apart from the mark as shown.”
Please let me know if you would approve of my adding the disclaimer as described for each application (88191565, 88191575, and 88191582 SIGNAL PRESS and 88258049, 88258055, and 88258060 SP SIGNAL PRESS).
2. MARK DESCRIPTIONS
Further, we require an amended description of the mark in each application for completion and clarity. The suggested description of the mark would read, with suggested changes in bold:
88191565, 88191575, and 88191582 SIGNAL PRESS:
The mark consists of the stylized word “SIGNAL” inside a shaded arrow pointing to the right over the stylized word “PRESS”.
88258049, 88258055, and 88258060 SP SIGNAL PRESS:
The mark consists of the stylized letter "S" consisting of two shaded semicircles next to the stylized letter "P" consisting of a shaded rectangle and a shaded semicircle with a shaded triangle on the left side of the semicircle all over the stylized words "SIGNAL PRESS".
88258064, 88258070, and 88258074 SP:
The mark consists of the stylized letter "S" consisting of two shaded red semicircles next to the stylized letter "P” consisting of a shaded red rectangle and a shaded black semicircle with a small shaded black triangle on the left side of the semicircle.
Please let me know if you would approve of my amending the mark descriptions as described for each application.
In summary, we require the following approvals from you:
1) Disclaimer as described above for each of the SP SIGNAL PRESS and SIGNAL PRESS applications.
2) Amended Description of the Mark as described above for each of the nine applications.
