TO AVOID ABANDONMENT OF APPLICANT’S TRADEMARK APPLICATION, THE USPTO MUST RECEIVE APPLICANT’S COMPLETE RESPONSE TO THIS LETTER WITHIN 6 MONTHS OF THE ISSUE/MAILING DATE BELOW. A RESPONSE TRANSMITTED THROUGH THE TRADEMARK ELECTRONIC APPLICATION SYSTEM (TEAS) MUST BE RECEIVED BEFORE MIDNIGHT EASTERN TIME OF THE LAST DAY OF THE RESPONSE PERIOD.

SEARCH RESULTS
In response to this Office action, applicant may present arguments in support of registration by addressing the issue of the potential conflict between applicant’s mark and the mark in the referenced application. Applicant’s election not to submit arguments at this time in no way limits applicant’s right to address this issue later if a refusal under Section 2(d) issues.
SUMMARY OF ISSUES APPLICANT MUST ADDRESS
In general, in the identification of goods, applicant must use the common commercial or generic names for the goods, be as complete and specific as possible, and avoid the use of indefinite words and phrases. TMEP §1402.03(a); see 37 C.F.R. §2.32(a)(6). If applicant uses indefinite words such as “apparatus,” “components,” “devices,” “materials,” or “parts,” such wording must be followed by “namely,” and a list of each specific product identified by its common commercial or generic name. See TMEP §§1401.05(d), 1402.03(a). The wording “Wireless tracking device” is not acceptable because the nature of the device is not provided, such as the components or how it functions, nor is the use provided, such as for the location of lost items. The wording “wireless tracking devices featuring short range wireless communications technology and GPS tracking devices” must be amended to provide a purpose, such as for locating lost items. The “electronic devices used to locate objects or articles employing radio frequency “must be amended to more clearly identify the nature of the devices. The software in “electronic tracking devices comprised of radio frequency modules in the nature of wireless transmitters and receivers, computer software and computer hardware, and electronic sensors, all for use in connection with object tracking and object monitoring” must be amended to provide a function, such as operating software. The wording “computer software for geolocation” is not acceptable because it does not clearly identify the purpose. Finally, the “computer hardware and software system for tracking objects using tracking devices” must be amended to make clear what the exact purpose is.
The “Golf clubs; golf balls; golf bags; golf accessories, including, golf ball markers, golf ball sleeves, golf tees, golf bag tags, and golf towel clips for attachment to bags; golf club covers” are all properly classified in Class 28, not 9. Applicant must amend the classification of these goods. In addition, the wording “including” in the identification of goods is indefinite and must be deleted and replaced with a definite term, such as “namely,” “consisting of,” “particularly,” or “in particular.” See 37 C.F.R. §2.32(a)(6); TMEP §§1402.01, 1402.03(a). The identification must be specific and all-inclusive. This wording is an open-ended term (e.g., “including,” “such as”) that is not acceptable because it fails to identify specific goods. See TMEP §1402.03(a).
Applicant’s goods and/or services may be clarified or limited, but may not be expanded beyond those originally itemized in the U.S. application or as acceptably amended. See 37 C.F.R. §2.71(a); TMEP §1402.06. Applicant may clarify or limit the identification by inserting qualifying language or deleting items to result in a more specific identification; however, applicant may not substitute different goods and/or services or add goods and/or services not found in or encompassed by those in the original U.S. application or as acceptably amended. See TMEP §1402.06(a)-(b). The scope of the goods and/or services sets the outer limit for any changes to the identification and is generally determined by the ordinary meaning of the wording in the identification. TMEP §§1402.06(b), 1402.07(a)-(b). Any acceptable changes to the goods and/or services will further limit scope, and once goods and/or services are deleted, they are not permitted to be reinserted. TMEP §1402.07(e). Additionally, for U.S. applications filed under Trademark Act Section 44(e), the scope of the identification for purposes of permissible amendments may not exceed the scope of the goods and/or services identified in the foreign registration. 37 C.F.R. §2.32(a)(6); Marmark, Ltd. v. Nutrexpa, S.A., 12 USPQ2d 1843, 1845 (TTAB 1989) (citing In re Löwenbräu München, 175 USPQ 178, 181 (TTAB 1972)); TMEP §§1012, 1402.01(b).

Applicant may adopt the following identification, if accurate:
International Class 9: Wireless tracking device in the nature of (identify the components of the device) for (identify the purpose, such as for tracking lost items); wireless tracking devices featuring short range wireless communications technology and GPS tracking devices for (identify the purpose, such as for tracking lost items); electronic devices comprised of radio transceivers used in communicating to and monitoring the distance of an object; electronic devices for locating and tracking an object or a lost articles using radio frequency; electronic devices used to locate objects or articles employing radio frequency, namely, (identify the components of the device); electronic tracking devices comprised of radio frequency modules in the nature of wireless transmitters and receivers, computer operating software and computer hardware, and electronic sensors, all for use in connection with object tracking and object monitoring; computer hardware for tracking the location of articles and objects; computer software for geolocation for (more clearly define the purpose or function); computer software for tracking objects using electronic tracking devices; computer software for tracking objects via radio frequency; computer software for locating, managing, and using an electronic tracking device and for providing alerts and notifications concerning the location of an electronic tracking device; downloadable computer software for users to enter, access, track, manage, monitor, and generate information regarding objects, articles and golf equipment and an electronic tracking device; downloadable software in the nature of a mobile application, namely, software for tracking electronic devices and objects; computer hardware and operating software system for tracking objects using tracking devices namely, (identify the devices) for (identify the purpose, such as for tracking lost items); computer hardware and software system for monitoring the distance between a mobile communications device and an electronic tracking device; computer hardware and software system for monitoring the distance between an electronic tracking device and an object;
International Class 28: Golf clubs; golf balls; golf bags; golf accessories, namely, golf ball markers, golf ball sleeves, golf tees, golf bag tags, and golf towel clips for attachment to bags; golf club covers.
MULTIPLE-CLASS APPLICATION REQUIREMENTS
Therefore, applicant must either (1) restrict the application to the number of classes covered by the fees already paid, or (2) submit the fees for each additional class.
The fee for adding classes to a TEAS Reduced Fee (RF) application is $275 per class. See 37 C.F.R. §§2.6(a)(1)(iii), 2.23(a). See more information regarding the requirements for maintaining the lower TEAS RF fee and, if these requirements are not satisfied, for adding classes at a higher fee using regular TEAS.
(1) List the goods and/or services by their international class number in consecutive numerical order, starting with the lowest numbered class.
(2) Submit a filing fee for each international class not covered by the fee(s) already paid (view the USPTO’s current fee schedule). The application identifies goods and/or services that are classified in at least TWO classes; however, applicant submitted a fee(s) sufficient for only ONE class(es). Applicant must either submit the filing fees for the classes not covered by the submitted fees or restrict the application to the number of classes covered by the fees already paid.

SUMMARY OF ISSUES APPLICANT MUST ADDRESS
TEAS PLUS OR TEAS REDUCED FEE (TEAS RF) APPLICANTS – TO MAINTAIN LOWER FEE, ADDITIONAL REQUIREMENTS MUST BE MET, INCLUDING SUBMITTING DOCUMENTS ONLINE: Applicants who filed their application online using the lower-fee TEAS Plus or TEAS RF application form must (1) file certain documents online using TEAS, including responses to Office actions (see TMEP §§819.02(b), 820.02(b) for a complete list of these documents); (2) maintain a valid e-mail correspondence address; and (3) agree to receive correspondence from the USPTO by e-mail throughout the prosecution of the application. See 37 C.F.R. §§2.22(b), 2.23(b); TMEP §§819, 820. TEAS Plus or TEAS RF applicants who do not meet these requirements must submit an additional processing fee of $125 per class of goods and/or services. 37 C.F.R. §§2.6(a)(1)(v), 2.22(c), 2.23(c); TMEP §§819.04, 820.04.
