The trademark examining attorney has searched the Office’s database of registered and pending marks and has found no conflicting marks that would bar registration under Trademark Act Section 2(d).  TMEP §704.02; see 15 U.S.C. §1052(d).

REFUSAL UNDER SECTION 2(e)(1) – MERELY DESCRIPTIVE

 

Registration is refused because the applied-for mark merely describes a feature, ingredient, characteristic, purpose, or function of applicant’s goods and/or services.  Trademark Act Section 2(e)(1), 15 U.S.C. §1052(e)(1); see TMEP §§1209.01(b), 1209.03 et seq.

 

An abbreviation, initialism, or acronym is merely descriptive when it is generally understood as “substantially synonymous” with the descriptive words it represents.  See In re Thomas Nelson, Inc., 97 USPQ2d 1712, 1715 (TTAB 2011) (citing Modern Optics, Inc. v. Univis Lens Co., 234 F.2d 504, 506, 110 USPQ 293, 295 (C.C.P.A. 1956)) (holding NKJV substantially synonymous with merely descriptive term “New King James Version” and thus merely descriptive of bibles); In re BetaBatt Inc., 89 USPQ2d 1152, 1155 (TTAB 2008) (holding DEC substantially synonymous with merely descriptive term “direct energy conversion” and thus merely descriptive of a type of batteries and battery related services); TMEP §1209.03(h).

 

A mark consisting of an abbreviation, initialism, or acronym will be considered substantially synonymous with descriptive wording if:

 

(1)    the applied-for mark is an abbreviation, initialism, or acronym for specific wording;

 

(2)    the specific wording is merely descriptive of applicant’s goods and/or services; and

 

(3) a relevant consumer viewing the abbreviation, initialism, or acronym in connection with applicant’s goods and/or services will recognize it as the equivalent of the merely descriptive wording it represents.

 

TMEP §1209.03(h); see In re Thomas Nelson, Inc., 97 USPQ2d at 1715-16 (citing In re Harco Corp., 220 USPQ 1075, 1076 (TTAB 1984)).

 

Here, applicant has applied to register “ALIS” for “automated logistics information system, namely, a browser based system that uses independent software to collect data from any number of disparate devices and correlates the data, events and alarms to identify the real situation and produce a turn-key distribution center gatehouse logistics solution”. 

 

In the present case, the attached evidence shows that applicant’s mark “ALIS” is an acronym for the wording “autonomic logistics information system” and/or “automated logistics information system.”  Further, the attached evidence shows that this wording is merely descriptive of a feature, purpose, and/or function of applicant’s goods/services.  Further, the wording “automated logistics information system” also appears in applicant’s identification.

 

Lastly, a relevant consumer viewing applicant’s mark in connection with the identified goods and/or services would recognize it as the equivalent of the descriptive wording it represents because applicant’s mark does not restrict its software to a particular use or field, and the software is for the automated collection of logistical data and information. 

 

Although applicant’s mark has been refused registration, applicant may respond to the refusal(s) by submitting evidence and arguments in support of registration.  However, if applicant responds to the refusal(s), applicant must also respond to the requirement(s) set forth below.

 

REQUIREMENT FOR INFORMATION

 

Due to the descriptive nature of the applied-for mark, applicant must provide the following information and documentation regarding the goods and/or services and wording appearing in the mark: 

 

(1)       Fact sheets, instruction manuals, brochures, advertisements and pertinent screenshots of applicant’s website as it relates to the goods and/or services in the application, including any materials using the terms in the applied-for mark.  Merely stating that information about the goods and/or services is available on applicant’s website is insufficient to make the information of record.; 

 

(2)       If these materials are unavailable, applicant should submit similar documentation for goods and services of the same type, explaining how its own product or services will differ.  If the goods and/or services feature new technology and information regarding competing goods and/or services is not available, applicant must provide a detailed factual description of the goods and/or services.  Factual information about the goods must make clear how they operate, salient features, and prospective customers and channels of trade.  For services, the factual information must make clear what the services are and how they are rendered, salient features, and prospective customers and channels of trade.  Conclusory statements will not satisfy this requirement.; and

 

(3)       Applicant must respond to the following questions: 

-        Do applicant’s competitors use ALIS to advertise similar goods and/or services?

-        Who is the typical consumer of applicant’s goods and/or services?

-        Where are applicant’s goods and/or services typically purchased (provide examples of store/venues)?

-        Are applicant’s goods/services applicable in the aerospace industry?

-        Are applicant’s goods/services applicable in the military?

-        Are the applicant’s goods/services solely web-based?

-        Are applicant’s goods downloadable software?

Failure to comply with a request for information is grounds for refusing registration.  In re Harley, 119 USPQ2d 1755, 1757-58 (TTAB 2016); TMEP §814. 

 

Requirement for Acceptable Identification of Services

 

Some of the wording in the recitation of goods/services must be clarified because it is indefinite and/or too broad.  See TMEP §1402.01.

 

The USPTO has the discretion to determine the degree of particularity needed to clearly identify goods and/or services covered by a mark.  In re Fiat Grp. Mktg. & Corp. Commc’ns S.p.A, 109 USPQ2d 1593, 1597 (TTAB 2014) (citing In re Omega SA, 494 F.3d 1362, 1365, 83 USPQ2d 1541, 1543-44 (Fed. Cir. 2007)).  Accordingly, the USPTO requires the description of goods and/or services in a U.S. application to be specific, definite, clear, accurate, and concise.  TMEP §1402.01; see In re Fiat Grp. Mktg. & Corp. Commc’ns S.p.A, 109 USPQ2d at 1597-98; Cal. Spray-Chem. Corp. v. Osmose Wood Pres. Co. of Am., 102 USPQ 321, 322 (Comm’r Pats. 1954). 

 

Where applicant’s goods/services are properly classified in other classes, applicant is required to either (1) specify the goods/services acceptably, add the appropriate international class(es) to the application, and classify the good/services therein, or (2) delete the good/services from the application.  See 37 C.F.R. §§2.86, 6.1; TMEP §§1403 et seq.

 

The wording in the identification of goods/services is indefinite, overly broad and must be clarified because it does not make clear the nature of the goods/services and may include goods/services in other international classes.  See 37 C.F.R. §2.32(a)(6); TMEP §1402.01.

 

In addition, software can be classified in three international classes (International Classes 9, 41, and 42) depending on whether the software is recorded on media, downloadable, or non-downloadable (either online or for temporary use), and if non-downloadable, whether it is game software.  For information regarding proper classification of computer software, see TMEP §§1402.03(d), 1402.11(a)(xii), and the USPTO’s online U.S. Acceptable Identification of Goods and Services Manual.

 

If applicant’s software is web-based, these services are classified in Class 42.  Specifically, web applications are software programs which users may access via the Internet.  These types of services are for non-downloadable software.

 

Applicant may adopt the following wording, if accurate:

 

Class 42:         Providing temporary use of a web-based software application for automated logistics information systems, namely, software for collection of data from devices for further correlating of data, events and alarms to identify the real situation and produce a turn-key distribution center gatehouse logistics solution, all for use in entry control of buildings or property.

 

Class 42:         Providing temporary use of a non-downloadable web application for automated logistics information systems, namely, software for collection of data from devices for further correlating of data, events and alarms to identify the real situation and produce a turn-key distribution center gatehouse logistics solution, all for use in entry control of buildings or property.

 

Applicant’s goods and/or services may be clarified or limited, but may not be expanded beyond those originally itemized in the application or as acceptably amended.  See 37 C.F.R. §2.71(a); TMEP §1402.06.  Applicant may clarify or limit the identification by inserting qualifying language or deleting items to result in a more specific identification; however, applicant may not substitute different goods and/or services or add goods and/or services not found or encompassed by those in the original application or as acceptably amended.  See TMEP §1402.06(a)-(b).  The scope of the goods and/or services sets the outer limit for any changes to the identification and is generally determined by the ordinary meaning of the wording in the identification.  TMEP §§1402.06(b), 1402.07(a)-(b).  Any acceptable changes to the goods and/or services will further limit scope, and once goods and/or services are deleted, they are not permitted to be reinserted.  TMEP §1402.07(e).

RESPONSE GUIDELINES

 

TEAS PLUS OR TEAS REDUCED FEE (TEAS RF) APPLICANTS – TO MAINTAIN LOWER FEE, ADDITIONAL REQUIREMENTS MUST BE MET, INCLUDING SUBMITTING DOCUMENTS ONLINE:  Applicants who filed their application online using the lower-fee TEAS Plus or TEAS RF application form must (1) file certain documents online using TEAS, including responses to Office actions (see TMEP §§819.02(b), 820.02(b) for a complete list of these documents); (2) maintain a valid e-mail correspondence address; and (3) agree to receive correspondence from the USPTO by e-mail throughout the prosecution of the application.  See 37 C.F.R. §§2.22(b), 2.23(b); TMEP §§819, 820.  TEAS Plus or TEAS RF applicants who do not meet these requirements must submit an additional processing fee of $125 per class of goods and/or services.  37 C.F.R. §§2.6(a)(1)(v), 2.22(c), 2.23(c); TMEP §§819.04, 820.04.  However, in certain situations, TEAS Plus or TEAS RF applicants may respond to an Office action by authorizing an examiner’s amendment by telephone or e-mail without incurring this additional fee.
