I am the newly assigned trademark examining attorney to whom this application has been assigned for review.

 

There are a few issues that we could resolve by examiner’s amendment to expedite the process, based on your reply to this email or a phone call. Please read each of the issues below and approve or answer each inquiry, as soon as possible. I need to act on this application on or before June 10, 2020 by the end of the day, EST time.

 

1)      Partial Refusal – Class 025 – Applicant’s mark was partially refused because of a likelihood of confusion with Reg. No. 4797143 for “STING”. Applicant may consent to deletion of this class to obviate the refusal and forward the application to publication in connection with Class 041. Please advise if applicant consents to this deletion.

 

2)      Identification of services: Classes 041 is indefinite. The following is suggested:

 

CLASS 041:          Entertainment services, namely, organizing and presenting live indoor professional American-style football games distributed via television, radio, global computer network and other forms of transmission media

 

Note: Applicant may amend the identification to clarify or limit the goods and/or services, but not to broaden or expand the goods and/or services beyond those in the original application or as acceptably amended.  See 37 C.F.R. §2.71(a); TMEP §1402.06.  Generally, any deleted goods and/or services may not later be reinserted.  See TMEP §1402.07(e).
