TEAS PLUS OR TEAS REDUCED FEE (TEAS RF) APPLICANTS – TO MAINTAIN LOWER FEE, ADDITIONAL REQUIREMENTS MUST BE MET, INCLUDING SUBMITTING DOCUMENTS ONLINE:  Applicants who filed their application online using the lower-fee TEAS Plus or TEAS RF application form must (1) file certain documents online using TEAS, including responses to Office actions (see TMEP §§819.02(b), 820.02(b) for a complete list of these documents); (2) maintain a valid e-mail correspondence address; and (3) agree to receive correspondence from the USPTO by e-mail throughout the prosecution of the application.  See 37 C.F.R. §§2.22(b), 2.23(b); TMEP §§819, 820.  TEAS Plus or TEAS RF applicants who do not meet these requirements must submit an additional processing fee of $125 per class of goods and/or services.  37 C.F.R. §§2.6(a)(1)(v), 2.22(c), 2.23(c); TMEP §§819.04, 820.04.  However, in certain situations, TEAS Plus or TEAS RF applicants may respond to an Office action by authorizing an examiner’s amendment by telephone or e-mail without incurring this additional fee.

SEARCH OF OFFICE RECORDS

 

The trademark examining attorney has searched the Office’s database of registered and pending marks and has found no conflicting marks that would bar registration under Trademark Act Section 2(d).  TMEP §704.02; see 15 U.S.C. §1052(d).

 

However, applicant must respond to each refusal and/or requirement set forth below.

 

 

DISCLAIMER REQUIREMENT

 

Applicant must disclaim the wording “BOTANICAL” apart from the mark as shown because it describes a feature, characteristic, function, quality, ingredient, purpose or use of applicant’s goods and/or services. See 15 U.S.C. §1056(a); TMEP §§1213, 1213.03(a).

 

The Office can require an applicant to disclaim an unregistrable part of a mark consisting of particular wording, symbols, numbers, design elements, or combinations thereof.  15 U.S.C. §1056(a).  Under Trademark Act Section 2(e), the Office can refuse registration of an entire mark if the entire mark is merely descriptive, deceptively misdescriptive, or primarily geographically descriptive of the goods.  15 U.S.C. §1052(e).  Thus, the Office may require an applicant to disclaim a portion of a mark that, when used in connection with the goods or services, is merely descriptive, deceptively misdescriptive, primarily geographically descriptive, or otherwise unregistrable (e.g., generic).  See 15 U.S.C. §1056(a); TMEP §§1213, 1213.03(a).

 

The term BOTANICAL is defined as “a substance obtained or derived from a plant: such as a medicinal preparation derived from a plant”. (See attachment from http://www.merriam-webster.com/dictionary/botanical).  As used in the applied-for mark, the term “botanical” describes a feature of the services in that applicant conducts research and develops drugs from plants.

 

The computerized printing format for the Office’s Trademark Official Gazette requires a standardized format for a disclaimer.  TMEP §1213.08(a)(i).  The following is the standard format used by the Office:

 

No claim is made to the exclusive right to use “BOTANICAL” apart from the mark as shown.

 

TMEP §1213.08(a)(i); see In re Owatonna Tool Co., 231 USPQ 493 (Comm’r Pats. 1983).

 

Failure to comply with a disclaimer requirement can result in a refusal to register the entire mark.  TMEP §1213.01(b).

 

REQUEST FOR ADDITIONAL INFORMATION

To permit proper examination of the application, applicant must submit additional information about applicant’s goods and/or services.  See 37 C.F.R. §2.61(b); TMEP §§814, 1402.01(e). Factual information about the goods must clearly indicate how they operate, their salient features, and their prospective customers and channels of trade.  Factual information about the services must clearly indicate what the services are and how they are rendered, their salient features, and their prospective customers and channels of trade.  Conclusory statements will not satisfy this requirement for information.

In addition, applicant must respond to the following in writing:

1.     Do or will any of applicant’s identified services include or involve the sale, distribution, delivery, dispensing, possession, or provision of marijuana, cannabis, hemp, or any preparations, oils, extracts, derivatives or compounds from cannabis, hemp or marijuana?

2.     Do or will any of applicant’s identified services include or involve the use of cannabis with a delta-9 tetrahydrocannabinol (THC) concentration of more than 0.3 percent on a dry weight basis?

3.     Do or will any of applicant’s identified services include or involve the possession of cannabidiol (CBD)?

4.     Do or will any of applicant’s identified services include or involve the possession of tetrahydrocannabinol (THC)?

5.     Do or will any of applicant’s identified services include or enable applicant or applicant’s consumers to distribute, disseminate, sell, barter, trade, exchange, purchase cannabis, hemp, marijuana, or any preparations, oils, extracts, derivatives or compounds from cannabis, hemp or marijuana?

6.     Is applicant authorized to conduct clinical trials or studies with DEA approval?

7.     Upon information and belief, do applicant’s services comply with the Controlled Substances Act (CSA)?

 

 

Failure to respond to a request for information is an additional ground for refusing registration.  See In re Cheezwhse.com, Inc., 85 USPQ2d 1917, 1919 (TTAB 2008); In re DTI P’ship LLP, 67 USPQ2d 1699, 1701 (TTAB 2003); TMEP §814.

 

Applicant is advised that, upon consideration of the information provided by applicant in response to the above requirement, registration of the applied-for mark may be refused on the ground that the mark, as used in connection with the identified goods and/or services, is not in lawful use in commerce.  Trademark Act Sections 1 and 45, 15 U.S.C. §§1051, 1127.
