OFFICE ACTION
TO AVOID ABANDONMENT OF APPLICANT’S TRADEMARK APPLICATION, THE USPTO MUST RECEIVE APPLICANT’S COMPLETE RESPONSE TO THIS LETTER WITHIN 6 MONTHS OF THE ISSUE/MAILING DATE BELOW. A RESPONSE TRANSMITTED THROUGH THE TRADEMARK ELECTRONIC APPLICATION SYSTEM (TEAS) MUST BE RECEIVED BEFORE MIDNIGHT EASTERN TIME OF THE LAST DAY OF THE RESPONSE PERIOD.

This Office action is supplemental to and supersedes the previous Office action issued on April 2, 2019 in connection with this application. Based on information and/or documentation in applicant’s response, the trademark examining attorney now issues the following new refusal; Trademark Act Section 2(d) Refusal for likelihood of confusion against the mark MAZAJ in U.S. Registration 4184196. See TMEP §§706, 711.02.
In a previous Office action dated April 2, 2019, the trademark examining attorney refused registration of the applied-for mark based on the following: Trademark Act Section 2(d) for a likelihood of confusion with a registered mark. In addition, applicant was required to satisfy the following requirement: identification of goods. Also, an advisory was issued regarding a prior-filed application that, if registered, may be a potential conflict against the applied-for mark.
Based on applicant’s response, the trademark examining attorney notes that the identification of goods requirement has been satisfied. See TMEP §713.02.
The following is a SUMMARY OF ISSUES that applicant must address:

Applicant must respond to all issues raised in this Office action within six (6) months of the date of issuance of this Office action. 37 C.F.R. §2.62(a); see TMEP §711.02. If applicant does not respond within this time limit, the application will be abandoned. 37 C.F.R. §2.65(a).
In response to this Office action, applicant may present arguments in support of registration by addressing the issue of the potential conflict between applicant’s mark and the mark in the referenced application. Applicant’s election not to submit arguments at this time in no way limits applicant’s right to address this issue later if a refusal under Section 2(d) issues for this application.
SECTION 2(d) REFUSAL – LIKELIHOOD OF CONFUSION
Applicant seeks to register the standard character mark MOOD for “non-alcoholic beverages, namely, non-alcoholic cocktail mixes; non-alcoholic cocktail bases; non-alcoholic beverages containing fruit juices; non-alcoholic cocktails; non-alcoholic beverages containing fruit juices, vegetable juices and/or herbal juices; carbonated beverages; flavored waters; soft drinks containing fruit juices, vegetable juices and herbal juices” in International Class 32.
Registrant’s standard character mark MOODE is registered for “Distilled spirits” in International Class 33.
Registrant’s standard character mark MAZAJ is registered for “Artificial coffee and tea; Beverages made of tea; Beverages with a tea base; Black tea; Chai tea; Coffee and tea; Disposable cups with a tea-filled pouch ultrasonically welded to one side of the bottom of the cup, which allows the natural fiber pouch to float near the bottom; Flavourings of tea; Fruit teas; Ginseng tea; Green tea; Herb tea; Herbal tea; Iced tea; Instant tea; Japanese green tea; Lime tea; Mixes in the nature of concentrates, syrups or powders used in the preparation of tea based beverages; Oolong tea; Sage tea; Syrups for making tea; Tea; Tea bags; Tea extracts; Tea for infusions; Tea of parched powder of barley with husk (mugi-cha); Tea of salty kelp powder (kombu-cha); Tea pods; Tea substitutes; Tea-based beverages; Tea-based beverages with fruit flavoring; Theine-free tea sweetened with sweeteners” in International Class 30.
Trademark Act Section 2(d) bars registration of an applied-for mark that is so similar to a registered mark that it is likely consumers would be confused, mistaken, or deceived as to the commercial source of the goods of the parties. See 15 U.S.C. §1052(d). Likelihood of confusion is determined on a case-by-case basis by applying the factors set forth in In re E. I. du Pont de Nemours & Co., 476 F.2d 1357, 1361, 177 USPQ 563, 567 (C.C.P.A. 1973) (called the “du Pont factors”). In re i.am.symbolic, llc, 866 F.3d 1315, 1322, 123 USPQ2d 1744, 1747 (Fed. Cir. 2017). Only those factors that are “relevant and of record” need be considered. M2 Software, Inc. v. M2 Commc’ns, Inc., 450 F.3d 1378, 1382, 78 USPQ2d 1944, 1947 (Fed. Cir. 2006) (citing Shen Mfg. Co. v. Ritz Hotel Ltd., 393 F.3d 1238, 1241, 73 USPQ2d 1350, 1353 (Fed. Cir. 2004)); see In re Inn at St. John’s, LLC, 126 USPQ2d 1742, 1744 (TTAB 2018).
Although not all du Pont factors may be relevant, there are generally two key considerations in any likelihood of confusion analysis: (1) the similarities between the compared marks and (2) the relatedness of the compared goods. See In re i.am.symbolic, llc, 866 F.3d at 1322, 123 USPQ2d at 1747 (quoting Herbko Int’l, Inc. v. Kappa Books, Inc., 308 F.3d 1156, 1164-65, 64 USPQ2d 1375, 1380 (Fed. Cir. 2002)); Federated Foods, Inc. v. Fort Howard Paper Co.,544 F.2d 1098, 1103, 192 USPQ 24, 29 (C.C.P.A. 1976) (“The fundamental inquiry mandated by [Section] 2(d) goes to the cumulative effect of differences in the essential characteristics of the goods [or services] and differences in the marks.”); TMEP §1207.01.
Similarity of the Marks
Marks are compared in their entireties for similarities in appearance, sound, connotation, and commercial impression. Stone Lion Capital Partners, LP v. Lion Capital LLP, 746 F.3d 1317, 1321, 110 USPQ2d 1157, 1160 (Fed. Cir. 2014) (quoting Palm Bay Imps., Inc. v. Veuve Clicquot Ponsardin Maison Fondee En 1772, 396 F.3d 1369, 1371, 73 USPQ2d 1689, 1691 (Fed. Cir. 2005)); TMEP §1207.01(b)-(b)(v). “Similarity in any one of these elements may be sufficient to find the marks confusingly similar.” In re Inn at St. John’s, LLC, 126 USPQ2d 1742, 1746 (TTAB 2018) (citing In re Davia, 110 USPQ2d 1810, 1812 (TTAB 2014)); TMEP §1207.01(b).
MOODE
The marks are essentially phonetic equivalents and thus sound similar. Similarity in sound alone may be sufficient to support a finding that the marks are confusingly similar. In re White Swan Ltd., 8 USPQ2d 1534, 1535 (TTAB 1988); see In re 1st USA Realty Prof’ls, Inc., 84 USPQ2d 1581, 1586 (TTAB 2007); TMEP §1207.01(b)(iv). In this case, the applicant merely removed the letter “E” from the registration, which may still render the pronunciation of the applied-for mark the same as the pronunciation of the registered mark. Even with slight differences in sound, this will not avoid a likelihood of confusion. In re Energy Telecomm. & Elec. Ass’n, 222 USPQ 350, 351 (TTAB 1983); see In re Viterra Inc., 671 F.3d 1358, 1367, 101 USPQ2d 1905, 1912 (Fed. Cir. 2012).
Generally, there is no correct pronunciation of a mark because it is impossible to predict how the public will pronounce a particular mark. See Embarcadero Techs., Inc. v. RStudio, Inc., 105 USPQ2d 1825, 1835 (TTAB 2013) (quoting In re Viterra Inc., 671 F.3d 1358, 1367, 101 USPQ2d 1905, 1912 (Fed. Cir. 2012); In re The Belgrade Shoe Co., 411 F.2d 1352, 1353, 162 USPQ 227, 227 (C.C.P.A. 1969)); TMEP §1207.01(b)(iv). The marks in question could clearly be pronounced the same; such similarity in sound alone may be sufficient to support a finding that the marks are confusingly similar. In re White Swan Ltd., 8 USPQ2d 1534, 1535 (TTAB 1988); see In re 1st USA Realty Prof’ls, Inc., 84 USPQ2d 1581, 1586 (TTAB 2007); TMEP §1207.01(b)(iv).
Therefore, because the marks are phonetic equivalents, they are confusingly similar.
MAZAJ
The registrant’s mark is in Urdu, which is a common, modern language in the United States. The doctrine is applied when “the ordinary American purchaser” would “stop and translate” the foreign term into its English equivalent. Palm Bay, 396 F.3d at 1377, 73 USPQ2d at 1696 (quoting In re Pan Tex Hotel Corp., 190 USPQ 109, 110 (TTAB 1976)); TMEP §1207.01(b)(vi)(A). The ordinary American purchaser includes those proficient in the foreign language. In re Spirits Int’l, N.V., 563 F.3d 1347, 1352, 90 USPQ2d 1489, 1492 (Fed. Cir. 2009); see In re Thomas, 79 USPQ2d at 1024.
In this case, the ordinary American purchaser would likely stop and translate the mark because the Urdu language is a common, modern language spoken by an appreciable number of consumers in the United States.
Thus, because the registered mark MAZAJ translates to the wording “MOOD, the applied-for mark MOOD is merely the English translation of MAZAJ and thus is likely to cause confusion under the foreign equivalent doctrine.
Please note that the applicant did not argue against the similarity of the applied-for mark and the registered mark MOODE in its response dated May 6, 2019.
Similarity of the Goods
MOODE
The previously attached Internet evidence from Crown Valley, Cutwater, Dogfish Head Craft Brewery Inc., Godiva and New Holland Brewing and the additional attached evidence from Huber’s Orchard and Winery & Vineyards, Montanya Distillers establishes that the same entity commonly manufactures, provides, and markets the relevant goods under the same mark. Specifically, these companies provide non-alcoholic beverages and distilled spirits. Thus, applicant’s and registrant’s goods are considered related for likelihood of confusion purposes. See, e.g., In re Davey Prods. Pty Ltd., 92 USPQ2d 1198, 1202-04 (TTAB 2009); In re Toshiba Med. Sys. Corp., 91 USPQ2d 1266, 1268-69, 1271-72 (TTAB 2009).
MAZAJ
The attached Internet evidence from Lipton, Starbucks, Arizona, Honest and Snapple establishes that the same entity commonly markets, provides, and sells the relevant goods under the same mark. Specifically, these companies provide non-alcoholic beverages, including, teas, coffees, and juices. Thus, applicant’s and registrant’s goods are considered related for likelihood of confusion purposes. See, e.g., In re Davey Prods. Pty Ltd., 92 USPQ2d 1198, 1202-04 (TTAB 2009); In re Toshiba Med. Sys. Corp., 91 USPQ2d 1266, 1268-69, 1271-72 (TTAB 2009).
Please note that the applicant did not argue against the similarity of the goods in its response dated May 6, 2019. However, applicant stated that its amendment of identification of goods is sufficient for the withdrawal of the Trademark Act Section 2(d) Refusal. For the reasons above, the mere identification of goods amendment is not sufficient to overcome the refusal. Because the marks are confusingly similar and the goods are presumed to travel in the same trade channels, the applied-for mark is refused registration under Trademark Act Section 2(d) for likelihood of confusion.
Although applicant’s mark has been refused registration, applicant may respond to the refusal by submitting evidence and arguments in support of registration. However, if applicant responds to the refusal, applicant must also respond to the requirement set forth below.
Response guidelines. For this application to proceed, applicant must explicitly address the refusal in this Office action. For a refusal, applicant may provide written arguments and evidence against the refusal, and may have other response options if specified above. Please see “Responding to Office Actions” and the informational video “Response to Office Action” for more information and tips on responding.
TEAS PLUS OR TEAS REDUCED FEE (TEAS RF) APPLICANTS – TO MAINTAIN LOWER FEE, ADDITIONAL REQUIREMENTS MUST BE MET, INCLUDING SUBMITTING DOCUMENTS ONLINE: Applicants who filed their application online using the lower-fee TEAS Plus or TEAS RF application form must (1) file certain documents online using TEAS, including responses to Office actions (see TMEP §§819.02(b), 820.02(b) for a complete list of these documents); (2) maintain a valid e-mail correspondence address; and (3) agree to receive correspondence from the USPTO by e-mail throughout the prosecution of the application. See 37 C.F.R. §§2.22(b), 2.23(b); TMEP §§819, 820.
