The referenced application has been reviewed by the assigned trademark examining attorney.
DATABASE SEARCH: The trademark examining attorney has searched the USPTO’s database of registered and pending marks and has found no similar registered marks that would bar registration under Trademark Act Section 2(d). TMEP §704.02; see 15 U.S.C. §1052(d). However, a mark in a prior-filed pending application may present a bar to registration of applicant’s mark. A suspension letter will follow with a copy of prior pending application no. 88226634 attached.
APPLICATION HAS BEEN AMENDED: In accordance with the authorization granted by applicant’s attorney, Daniel Kattman, on Friday, March 22, 2019, the trademark examining attorney has amended the application as indicated below. Please advise the undersigned immediately of any objections. Otherwise, no response is necessary. TMEP §707. Any amendments to the identification of services may clarify or limit the services, but may not add to or broaden the scope of the services. 37 C.F.R. §2.71(a); see TMEP §§1402.06 et seq.
The identification of services is amended to read as follows:
IC 042: “Software as a service (SAAS) services featuring mobile device software applications and web-based software applications to track and publish construction site code and regulation compliance and environmental regulation compliance; software as a service (SAAS) services featuring software to generate and publish reports and assessments in the field of construction site code and regulation compliance and environmental regulation compliance and enable communication and improve productivity among contractors and construction project team members; providing a web-based system and on-line portal to automate construction site code and regulation compliance and environmental regulation compliance and enable communication and improve productivity among contractors and construction project team members; Software as a service (SAAS) services featuring mobile device software applications and web-based software application to track the location, quantity and availability of unused or excess construction materials, building raw materials, construction equipment and construction site resources, improve efficiency, resource utilization and reduce waste and reduce emissions on construction sites and construction projects and enable communication and improve productivity among contractors and construction project team members; maintaining on-line database systems for others that track the location, quantity and availability of unused or excess construction materials, building raw materials, construction equipment and construction site resource.”

WHAT HAPPENS NEXT: After an examiner’s amendment issues, the trademark examining attorney will suspend the application in light of the prior pending registration, which is detailed in the suspension letter to follow.
