INQUIRY – ENGLISH TRANSLATION AND TRANSLITERATION

 

To permit proper examination of the application, applicant must specify whether the non-Latin characters have any meaning in a foreign language.  See 37 C.F.R. §§2.32(a)(9)-(a)(10), 2.61(b); TMEP §§809, 814. 

 

If the non-Latin characters have a meaning in a foreign language, applicant must provide an English translation.  37 C.F.R. §§2.32(a)(9)-(a)(10), 2.61(b); TMEP §809.  For text in non-Latin characters, applicant must also provide a transliteration (a phonetic spelling of the pronunciation, in Latin characters).  See 37 C.F.R. §§2.32(a)(10), 2.61(b); TMEP §809.  If the non-Latin characters have no meaning in a foreign language, applicant must so specify.  See 37 C.F.R. §§2.32(a)(10), 2.61(b); TMEP §809.  Please see attached evidence of transliteration for the non-Latin characters.  The examining attorney, however, has not been able to find an exact translation of the characters in context, and so applicant must provide one.

 

Applicant should provide an English translation and transliteration using the following format:

 

The non-Latin characters in the mark transliterate to “SHAN QIAN” and this means “              ” in English.

Alternatively, if the non-Latin characters in the mark have no meaning in a foreign language, applicant should provide the following statements:

REQUIREMENT – COUNTRY OF INCORPORATION

 

Applicant must specify its country of incorporation.  37 C.F.R. §2.32(a)(3)(ii); TMEP §§803.03(c), 803.04.  This information is required in all U.S. trademark applications.  See 37 C.F.R. §2.32(a)(3)(ii); TMEP §§803.03, 803.04. 

 

If applicant is organized under the laws of a foreign province or geographical region, applicant should specify both the foreign province or geographical region and the foreign country in which the province or region is located.  See TMEP §803.04. 

 

To provide this information online via the Trademark Electronic Application System (TEAS) response form, applicant must:

(1) locate the “Entity Type” heading and select “Other;”

(2) locate the “Specify Entity Type” heading and select “Other” under the Foreign Entity option, and enter in the free-text field below both applicant’s entity type and the foreign province or geographical region of its organization (e.g., partnership of Victoria); and

(3) locate the “State or Country Where Legally Organized” heading and select the appropriate foreign country (e.g., Australia) under the Non-U.S. Entity option.  See id.

 

 

REQUIREMENT – AMEND THE IDENTIFICATION OF GOODS

 

The identification of goods in unacceptable and must be clarified because it contains indefinite wording, wording that is misclassified, and wording that is too broad and could include goods in other international classes.  See 37 C.F.R. §2.32(a)(6), (7), 2.85; TMEP §§1402.01, 1401.02(a), 1401.03(b), 1402.03, 1402.03(b). 

 

The wording “intraocular implants for changing eye color made of artificial materials” in the identification of goods is indefinite and must be clarified because it does not specify the material composition of the implants.  Additionally, these goods are more commonly known as intraocular lenses or prosthesis.  See 37 C.F.R. §2.32(a)(6); TMEP §1402.01. 

 

“Disposable teats” in the identification of goods is indefinite and must be clarified because it does not specify the type of good or the use for the goods.  See 37 C.F.R. §2.32(a)(6); TMEP §1402.01. 

 

The terms “apparatus for clinical diagnosis” in the identification of goods is indefinite and must be clarified because it fails to describe the specific medical use, purpose, and/or function of the apparatus.  See 37 C.F.R. §2.32(a)(6); TMEP §§1401.05(b), 1402.01.  Providing “clinical diagnosis” as the field of use is not sufficient because International Class 10 encompasses all medical apparatus; the identification must unambiguously specify the medical use, purpose, and/or function of these medical goods.  For example, “blood pressure and diabetic diagnostic medical apparatus,” “medical device for detecting cancer,” “medical apparatus for clinical diagnosis of congestive heart failure,” are acceptable in International Class 10.

 

Further, the wording “surgical implants” in the identification of goods must be clarified because it is too broad and could include goods in other international classes.  See 37 C.F.R. §2.32(a)(6); TMEP §§1402.01, 1402.03.  In particular, this wording could encompass “surgical implants comprising living tissue” in Class 5, or “surgical implants comprising artificial material for use in knee surgery” in Class 10.

 

The term “teats” in the identification of goods is indefinite and must be clarified because the field of use or purpose of the teats.  See 37 C.F.R. §2.32(a)(6); TMEP §1402.01.

 

“Breathalyzers” in the identification of goods is a registered mark not owned by applicant; accordingly, applicant must amend the identification to delete this wording and, if not already included in the identification, provide the common commercial or generic name of the goods.  TMEP §1402.09; see 37 C.F.R. §2.32(a)(6); Camloc Fastener Corp. v. Grant, 119 USPQ 264, 264 n.1 (TTAB 1958).  See the attached U.S. Registration No. 0661636. 

 

Identifications of goods should generally be comprised of generic everyday wording for the goods, and exclude proprietary or potentially-proprietary wording.  See TMEP §§1402.01, 1402.09.  A registered mark indicates origin in one particular party and so may not be used to identify goods that originate in a party other than that registrant.  TMEP §1402.09 (citing Camloc Fastener Corp. v. Grant, 119 USPQ at 264 n.1). 

 

Applicant may replace such wording with the following, if appropriate:  “alcohol breath testing units.”

 

Additionally, the wording “medical bags sold empty” in the identification of goods is indefinite and must be clarified because it does not specify the use or purpose of the goods.  See 37 C.F.R. §2.32(a)(6); TMEP §1402.01. 

 

The wording “filters for blood and blood components” in the identification of goods must be clarified because it is too broad and could include goods in other international classes.  See 37 C.F.R. §2.32(a)(6); TMEP §§1402.01, 1402.03.  In particular, this wording could encompass: “filters for blood and blood components for laboratory use” in Class 9, or “filters for blood and blood components for medical purposes” in Class 10.

 

The term “endoscopy cameras” in the identification of goods is indefinite and overbroad and must be clarified because it does not specify the use and/or purpose of the goods.  See 37 C.F.R. §2.32(a)(6); TMEP §1402.01, 1402.03.  In particular, this wording could encompass: “endoscopy cameras for industrial purposes” in Class 9, or “endoscopy cameras for medical purposes” in Class 10.

 

Further, the term “endoscopic equipment” in the identification of goods is indefinite and overbroad and must be clarified because it does not specify the use and/or purpose of the goods.  See 37 C.F.R. §2.32(a)(6); TMEP §1402.01, 1402.03.  In particular, this wording could encompass: “endoscopy equipment for industrial purposes” in Class 9, or “endoscopy equipment for medical purposes” in Class 10.

 

Applicant has classified “medical apparatus, namely, adhesive tape for sealing plastic ice bags” in International Class 10; however, the proper classification is International Class 5.  Therefore, applicant may respond by (1) adding International Class 5 to the application and reclassifying these goods in the proper international class, (2) deleting “medical apparatus, namely, adhesive tape for sealing plastic ice bags” from the application, or (3) deleting the remainder of the items in the identification and reclassifying the specified goods in the proper international class.  See 37 C.F.R. §§2.86(a), 6.1; TMEP §§1403.02 et seq.  If applicant adds one or more international classes to the application, applicant must comply with the multiple-class requirements specified in this Office action.

 

The terms “medical wearing apparel, namely, scrub tops,” “medical wearing apparel, namely, scrub pants,” and “medical wearing apparel, namely, caps” in the identification of goods is indefinite and must be clarified because it does not specify the exact medical use or purpose.  See 37 C.F.R. §2.32(a)(6); TMEP §1402.01.  Applicant may substitute the following wording, if accurate: “surgical scrub tops,” “surgical scrub pants,” and “surgical caps.” However, please note that applicant has already listed “surgical scrub tops,” “surgical scrub pants” and “surgical caps,” in the identification of goods.

 

Applicant is advised that duplicate entries in the identification of goods is not permitted. See generally TMEP §§1402.01, 1402.01(a). 

 

Moreover, “medical wearing apparel, namely, shoes” in the identification of goods is indefinite and overbroad, and must be clarified because it does not specify the exact use and/or purpose of the goods.  See 37 C.F.R. §2.32(a)(6); TMEP §1402.01, 1402.03.  In particular, this wording could encompass: “surgical shoe covers,” “post-surgical shoes,” or “shoes for medical use, namely, prophylactic and therapeutic footwear for diabetics and rheumatics” in Class 10.

 

Applicant has classified “paper for use on examination tables” in International Class 10; however, the proper classification is International Class 16.  Therefore, applicant may respond by (1) adding International Class 16 to the application and reclassifying these goods in the proper international class, (2) deleting “paper for use on examination tables” from the application, or (3) deleting the remainder of the items in the identification and reclassifying the specified goods in the proper international class.  See 37 C.F.R. §§2.86(a), 6.1; TMEP §§1403.02 et seq.  If applicant adds one or more international classes to the application, applicant must comply with the multiple-class requirements specified in this Office action.

 

Applicant has also misclassified “home urine collection kit consisting of test tubes, pipette, and self-mailer used to determine a person's nutraceutical needs” in International Class 10; however, the proper classification is International Class 9.  Generally, a kit is classified in the same international class as the majority of the components in the kit.  See TMEP §1401.05(a). For example, “nail care kits comprised of nail polish, nail polish remover, false nails, nail files, and printed instructions” are in International Class 3, the class of the kits’ primary components which are listed first in the kits’ components (with “nail files” in International Class 8, and “printed instructions” in International Class 16 listed after the International Class 3 components). See id.

 

Therefore, applicant may respond by (1) adding International Class 9 to the application and reclassifying these goods in the proper international class, (2) deleting “home urine collection kit consisting of test tubes, pipette, and self-mailer used to determine a person's nutraceutical needs” from the application, or (3) deleting the remainder of the items in the identification and reclassifying the specified goods in the proper international class.  See 37 C.F.R. §§2.86(a), 6.1; TMEP §§1403.02 et seq.  If applicant adds one or more international classes to the application, applicant must comply with the multiple-class requirements specified in this Office action.

 

The term “medical apparatus, namely, plastic handles for use in the application of plastic film around ice bags” in the identification of goods is indefinite and must be clarified because the nature of the goods is unclear.  Further, it is unclear how the goods function as a medical apparatus for the diagnosis or treatment of a patient under Class 10.  See 37 C.F.R. §2.32(a)(6); TMEP §1402.01. 

 

The wording “bougies” in the identification of goods must be clarified because it is too broad and could include goods in other international classes.  See 37 C.F.R. §2.32(a)(6); TMEP §§1402.01, 1402.03.  In particular, this wording could encompass “bougies in the nature of wax candles” in Class 4, or “surgical bougies in Class 10.

 

Also, the wording “oxygen inhalators” in the identification of goods must be clarified because it is too broad and could include goods in other international classes.  See 37 C.F.R. §2.32(a)(6); TMEP §§1402.01, 1402.03.  In particular, this wording could encompass “inhalers filled with oxygen for medical use” in Class 5, or “oxygen inhalators for medical use, sold empty” in Class 10.

 

“Robotic arms for surgical purposes” in the identification of goods is indefinite and must be clarified because the wording is ambiguous as to the nature of the goods.  See 37 C.F.R. §2.32(a)(6); TMEP §1402.01.  Applicant may substitute the following wording, if accurate:  “surgical robots.” However, please note that applicant has already listed “surgical robots” in the identification of goods.

 

Applicant is advised that duplicate entries in the identification of goods is not permitted. See generally TMEP §§1402.01, 1402.01(a). 

 

The wording “MRI diagnostic apparatus” in the identification of goods must be clarified because it is too broad and could include goods in other international classes.  See 37 C.F.R. §2.32(a)(6); TMEP §§1402.01, 1402.03.  In particular, this wording could encompass: “MRI apparatus, not for medical purposes” in Class 9, “MRI apparatus for medical purposes,” or “Radiological apparatus for diagnostic and medical purposes, namely, a helium-3 polarizer used for magnetic resonance imaging (MRI) of the lungs” in Class 10.

 

Applicant has classified “rolls of paper for covering examination tables used in hospitals, doctor's offices, and other similar health care environments”  and “disposable headrest covers for medical and dental examination chairs” in International Class 10; however, the proper classification is International Class 16 and applicant needs to specify that the goods are made of paper.  Therefore, applicant may respond by (1) adding International Class 16 to the application and reclassifying these goods in the proper international class, (2) deleting “Rolls of paper for covering examination tables used in hospitals, doctor's offices, and other similar health care environments” and “disposable headrest covers for medical and dental examination chairs” from the application, or (3) deleting the remainder of the items in the identification and reclassifying the specified goods in the proper international class.  See 37 C.F.R. §§2.86(a), 6.1; TMEP §§1403.02 et seq.  If applicant adds one or more international classes to the application, applicant must comply with the multiple-class requirements specified in this Office action.

 

“Decorative coverings for crutches” in the identification of goods is indefinite and must be clarified because it is unclear as to the type of good and its purpose.  See 37 C.F.R. §2.32(a)(6); TMEP §1402.01.  Applicant may substitute the following wording, if accurate:  “Fitted covers for underarm crutch pads.” However, please note that applicant has already listed “Fitted covers for underarm crutch pads” in the identification of goods.

 

Applicant is advised that duplicate entries in the identification of goods is not permitted. See generally TMEP §§1402.01, 1402.01(a). 

 

Applicant’s “trusses” wording in the identification of goods is indefinite and overbroad and must be clarified because it does not specify the use and/or purpose of the goods.  See 37 C.F.R. §2.32(a)(6); TMEP §1402.01, 1402.03.  In particular, this wording could encompass: “metal floor trusses” in Class 6, “hernia trusses” in Class 10, or “non-metal floor trusses” in Class 19.

 

“Magnetic resonance ct apparatus” in the identification of goods is indefinite and overbroad and must be clarified because it does not specify the use and/or purpose of the goods.  See 37 C.F.R. §2.32(a)(6); TMEP §1402.01, 1402.03.  In particular, this wording could encompass “Magnetic resonance imaging apparatus, not for medical purposes” in Class 9, or “Magnetic resonance imaging apparatus for medical purposes” in Class 10.  However, please note that applicant has already listed this particular goods in Class 10.

 

The terms “urinals for medical purposes being vessels” in the identification of goods is indefinite and must be clarified because the nature and purpose of the goods is unclear.  See 37 C.F.R. §2.32(a)(6); TMEP §1402.01. 

 

Applicant has also misclassified “Paper bags and envelopes for sterilizing medical instruments” in International Class 10; however, the proper classification is International Class 16 because the goods are made of paper.  Therefore, applicant may respond by (1) adding International Class 16 to the application and reclassifying these goods in the proper international class, (2) deleting “Paper bags and envelopes for sterilizing medical instruments” from the application, or (3) deleting the remainder of the items in the identification and reclassifying the specified goods in the proper international class.  See 37 C.F.R. §§2.86(a), 6.1; TMEP §§1403.02 et seq.  If applicant adds one or more international classes to the application, applicant must comply with the multiple-class requirements specified in this Office action.

 

Furthermore, the wording “health trusses” in the identification of goods is indefinite and must be clarified because it does not clarify the nature and/or purpose of the goods.  See 37 C.F.R. §2.32(a)(6); TMEP §1402.01.  Applicant may substitute the following wording, if accurate:  “Hernia trusses,” which is the common commercial name for this type of apparatus.  However, please note that applicant has already listed “hernia trusses” in the identification of goods.

 

Applicant is advised to delete or modify the duplicate entry in the identification of goods for “Dental bite trays” and “Stretchers for patient transport.” See generally TMEP §§1402.01, 1402.01(a).  If applicant does not respond to this issue, be advised that the USPTO will remove duplicate entries from the identification prior to registration.

 

If modifying one of the duplicate entries, applicant may amend it to clarify or limit the goods, but not to broaden or expand the goods beyond those in the original application or as acceptably amended.  See 37 C.F.R. §2.71(a); TMEP §1402.06.  Also, generally, any deleted goods may not later be reinserted.  TMEP §1402.07(e).

Applicant’s goods may be clarified or limited, but may not be expanded beyond those originally itemized in the application or as acceptably amended.  See 37 C.F.R. §2.71(a); TMEP §1402.06.  Applicant may clarify or limit the identification by inserting qualifying language or deleting items to result in a more specific identification; however, applicant may not substitute different goods or add goods not found or encompassed by those in the original application or as acceptably amended.  See TMEP §1402.06(a)-(b).  The scope of the goods sets the outer limit for any changes to the identification and is generally determined by the ordinary meaning of the wording in the identification.  TMEP §§1402.06(b), 1402.07(a)-(b).  Any acceptable changes to the goods will further limit scope, and once goods are deleted, they are not permitted to be reinserted.  TMEP §1402.07(e).

MULTIPLE-CLASS APPLICATION REQUIREMENTS

 

The application identifies goods in more than one international class; therefore, applicant must satisfy all the requirements below for each international class based on Trademark Act Section 1(b):

 

(1)       List the goods and/or services by their international class number in consecutive numerical order, starting with the lowest numbered class.

 

(2)       Submit a filing fee for each international class not covered by the fee already paid (view the USPTO’s current fee schedule).  The application identifies goods that are classified in at least 7 classes; however, applicant submitted a fee sufficient for only 1 class.  Applicant must either submit the filing fees for the classes not covered by the submitted fees or restrict the application to the number of classes covered by the fees already paid.
