I am an attorney with the U.S. Patent & Trademark Office, the federal agency to which you recently submitted a response in the above referenced trademark application. The amended identification of goods and foreign registration are acceptable. However, it is not clear from the response if the applicant would like to retain the Section 1(b) filing basis in addition to the perfected Section 44(e) filing basis.
If the applicant wishes to delete the Section 1(b) filing basis, please let me know and I will do an Examiner’s Amendment deleting it accordingly.
