Dear Mr. White,
I am the assigned trademark examining attorney for Trademark Application Serial No. 88229434 FRED. The application looks good, there is just a minor amendment we need to make before I can move the mark forward for publication.
Amendment of Goods Identification/Class
The goods identification in the application is currently overbroad and indefinite and must be modified for clarity in order to meet USPTO requirements. Specifically, the identification could indicate goods in International Class 011 instead of International Class 006. I have included suggestions for modified goods identifications below:
1. International Class 006: “Non-metal safes, namely, composite wood temperature controlled secure storage container for receiving and holding goods.”; or
2. International Class 011: “Composite wood temperature controlled secure storage container for receiving and holding goods, namely, temperature-controlled portable insulated shipping containers”; or
3. International Class 011: “Composite wood temperature controlled secure storage container for receiving and holding goods, namely, temperature controlled, refrigerated or heated mobile units for the storage and delivery of food products”
If your client’s goods are modified to be in International Class 011 instead of International Class 006, additional class fees will not be required because the fee for one class was already paid.
Please e-mail or call me back letting me know which goods identification language your client would like to adopt and I will issue an Examiner’s Amendment and move the application towards publication accordingly. If I do not hear from you by 5:00 PM EST Monday, March 25th, 2019, I will issue a formal Office Action with the requirements above.
