The trademark examining attorney has searched the Office’s database of registered and pending marks and has found no conflicting marks that would bar registration under Trademark Act Section 2(d). TMEP §704.02; see 15 U.S.C. §1052(d).
Summary of Issues to be Addressed by Applicant
Identification and Classification of Services
Some of the wording in the identification of services is indefinite and must be clarified because it is unclear as to the exact nature of the services, and because some of the wording is too broad and describes services in more than one international class. See 37 C.F.R. §2.32(a)(6); TMEP §§1402.01, 1402.03. In particular, the wording “build-to-order metal and non-metal structures” is indefinite. Applicant may clarify this wording by specifying the particular services involved, i.e., building construction services for others. Also, the wording “specialized items of metal and hardware” is indefinite and may be clarified by specifying the applicant provides welding services with regard to these items.
“Construction project management services in the field of welding, fabrication and repairs to buildings, structural works, platforms, catwalks, ladders and bridges; installation of equipment guards and safety guards, including handrails and guardrails; building construction services for others, namely, build-to-order metal and non-metal structures,” in International Class 37.
“Pipe welding and welding of specialized items of metal and hardware,” in International Class 40.

Advisory: Combined Applications
(1) List the services by their international class number in consecutive numerical order, starting with the lowest numbered class (for example, International Class 3: perfume; International Class 18: cosmetic bags sold empty).
(2) Submit a filing fee for each international class not covered by the fee(s) already paid (view the USPTO’s current fee schedule). Specifically, the application identifies services based on use in commerce that are classified in at least 2 classes; however, applicant submitted a fee(s) sufficient for only 1 class(es). Applicant must either (a) submit the filing fees for the classes not covered by the submitted fees or (b) restrict the application to the number of classes covered by the fees already paid.
(3) Submit verified dates of first use of the mark anywhere and in commerce for each international class. See more information about verified dates of use.
(4) Submit a specimen for each international class. The current specimen is acceptable for classes 37 and 40; See more information about specimens.
(5) Submit a verified statement that “The specimen was in use in commerce on or in connection with the goods and/or services listed in the application at least as early as the filing date of the application.” See more information about verification.

Disclaimer Required
In this case, applicant must disclaim the wording “AMERICAN” and “WELDING” because it is not inherently distinctive and is merely descriptive and primarily geographically descriptive of applicant’s services
The nondistinctive wording “WELDING” merely describes a characteristic, function, feature, purpose, or use of applicant’s services, which are identified as “construction project management services in the field of welding, fabrication and repairs to buildings, structural works, platforms, catwalks, ladders and bridges; installation of equipment guards and safety guards, including handrails and guardrails; build-to-order metal and non-metal structures; pipe welding and specialized items of metal and hardware.” See 15 U.S.C. §§1052(e)(1); DuoProSS Meditech Corp. v. Inviro Med. Devices, Ltd., 695 F.3d 1247, 1251, 103 USPQ2d 1753, 1755 (Fed. Cir. 2012).
The term “WELDING” appears in the identification of services. Therefore, this wording merely describes that applicant provides various welding services, and must be disclaimed.
In addition, the nondistinctive wording “AMERICAN” is primarily geographically descriptive of the origin of applicant’s services. See 15 U.S.C. §§1052(e)(2); In re Societe Generale des Eaux Minerales de Vittel S.A., 824 F.2d 957, 959, 3 USPQ2d 1450, 1451-52 (Fed. Cir. 1987); TMEP §§1210.01(a), 1210.06(a), 1213.03(a).
When AMERICA or AMERICAN appears in a mark such that it primarily denotes the country of the United States as the origin of the services, then the primary significance is as a geographic location. See In re Monograms Am., Inc., 51 USPQ2d 1317 (TTAB 1999); In re BankAmerica Corp., 231 USPQ 873 (TTAB 1986); Am. Diabetes Ass’n, Inc. v. Nat’l Diabetes Ass’n, 533 F. Supp. 16, 214 USPQ 231 (E.D. Pa. 1981), aff’d, 681 F.2d 804 (3d Cir. 1982); TMEP §1210.02(b)(iv).
Please see the attached dictionary definition of “AMERICAN,” defined as of or relating to the United States of America. Because the services originate in this place or location, a public association of the services with the place is presumed. See In re Hollywood Lawyers Online, 110 USPQ2d 1852, 1858 (TTAB 2014) (citing In re Spirits of New Merced, LLC, 85 USPQ2d 1614, 1621 (TTAB 2007)); TMEP §§1210.02(a) 1210.04.
