Date: August 12, 2019
To: Andrea Hack
Examining Attorney
From: Judy Grundy
Attorney Advisor
Office of the Deputy Commissioner
for Trademark Examination Policy
Subject: Letter of protest concerning U.S. Application Serial No. 88227411
for the mark SUPREME
A specimens protest filed before publication has been accepted. The Commissioner for Trademarks has determined that publication of the mark would result in a clear error based on the evidence submitted with the protest. The examining attorney must take appropriate action in accordance with the evidence contained herein. TMEP §1715.03.
The specimens protest raises the following objection:
The specimen submitted appears to consist of a digitally altered image or mock-up of the intended depiction of the mark on the goods and does not show the applied-for mark in actual use in commerce.
Please see the attached evidence and Trademark Act Sections 1 and 45, 15 U.S.C. §§1051, 1127; 37 C.F.R. §§2.34(a)(1)(iv), 2.56(a); TMEP §§904, 904.07(a).
