 The Office has reassigned this application to the undersigned trademark examining attorney.

 

On September 12, 2019, action on this application was suspended pending the disposition of U.S. Application Serial No. 88047049.  The referenced pending application has abandoned and is no longer a potential bar to the registration of applicant’s mark.

 

INTRODUCTION

This Office action is supplemental to and supersedes the previous Office action issued on September 12, 2019 in connection with this application.  Based on information and/or documentation in applicant’s response, the trademark examining attorney now issues the following new requirement:  Owner’s Email Required.  See TMEP §§706, 711.02. 

 

In a previous Office action dated March 11, 2019, the trademark examining attorney refused registration of the applied-for mark based on a likelihood of confusion with the mark in U.S. Registration No. 5602031.  That refusal is withdrawn.

 

The following is a SUMMARY OF ISSUES that applicant must address:

 

              NEW ISSUE: Owner’s Email Required

 

Applicant must respond to all issues raised in this Office action and the previous March 11, 2019 Office action, within six (6) months of the date of issuance of this Office action.  37 C.F.R. §2.62(a); see TMEP §711.02.  If applicant does not respond within this time limit, the application will be abandoned.  37 C.F.R. §2.65(a).

 

APPLICANT EMAIL REQUIRED

Applicant must provide applicant’s email address, which is a requirement for a complete application.  See 37 C.F.R. §2.32(a)(2); Mandatory Electronic Filing & Specimen Requirements, Examination Guide 1-20, at III.A. (Rev. Feb. 2020).  Applicant’s email address cannot be identical to the listed primary correspondence email address of any attorney retained to represent applicant in this application.  See Examination Guide 1-20, at III.A.
