To file a new Class 9 specimen for the ‘574 application, please use the TEAS Response to Office Action
form.
The other co-pending statement of use has been re-assigned to me, I will be examining it shortly. If it’s
the same issue with the Class 9 specimen, I will be issuing an Office action this evening.

Dear Examining Attorney Cohen:
I am a law school intellectual property clinic student attorney authorized to represent Ms. Cynthia
Pillsbury and oversee the registration process of her marks (88/218, 574 & 88/218, 584). I received
your Office Action and am hoping to resolve the issue by filing a request for extension by April 2 for the
IC009 portion of the application.
Issue 1: Instructions on the USPTO website indicate that this must be done on the SOU form. Due to
the fact that the SOU form has already been submitted, I am unable to go in and make these requests.
I have researched the TMEP and the USPTO’s website and have been unable to find clear guidance. Is
this something with which you can assist?
Issue 2: The client has a second application 88/218,584 being reviewed by Examining Attorney
Sparacino. This application has the same issue with IC 009; however, we did not receive an office
action. Do we raise this issue with him, or is it dependent on whether the individual Examining
Attorney flags the issue on the specific application? We do not want to risk missing the deadline to file
an extension request.
The deadline for this mark is this Thursday, April 2. If possible, I would like to set up a phone call with
you tomorrow morning (3/31) to discuss. Any help you can provide is greatly appreciated.
